National Wages Consultative Council Act 2011 s 22

s 22 Council to make recommendation

(1) Based on the actions taken under section 21, the Council shall, at such time as the Minister may determine, make a recommendation to the Government through the Minister on the following matters: (a) the minimum wages rates; (b) the coverage of the recommended minimum wages rates according to sectors, types of employment and regional areas; (c) the non-application of the recommended minimum wages rates and coverage to any sectors, types of employment and regional areas or to any person or class of persons; (d) the commencement of the minimum wages order and the different dates for the commencement of the minimum wages order to different sectors, types of employment and regional areas, or to different persons or class of persons; and (e) other matters relating to the minimum wages, including the implementation of the recommended minimum wages rates and coverage. (2) T h e G o v e r n m e n t m a y, a f t e r c o n s i d e r i n g t h e recommendation— (a) agree with the recommendation; or (b) direct the Council to review the recommendation within the period as the Government may determine and make a fresh recommendation. (3) Where the Government directs the Council to review the recommendation and make a fresh recommendation under paragraph (2)(b), section 21 and subsection (1) shall apply. (4) The Government may, after considering the fresh recommendation made pursuant to subsection (3)— (a) agree with the fresh recommendation; or (b) disagree with the fresh recommendation and determine the matters specified in paragraphs (1)(a) to (e).

Majlis hendaklah membuat syor

(1) Berdasarkan tindakan yang diambil di bawah seksyen 21, Majlis hendaklah, pada bila-bila masa yang ditentukan oleh Menteri, membuat syor kepada Kerajaan melalui Menteri tentang perkara yang berikut: (a) kadar gaji minimum; (b) liputan kadar gaji minimum yang disyorkan mengikut sektor, jenis pekerjaan dan kawasan wilayah; (c) ketidakpakaian kadar dan liputan gaji minimum yang disyorkan bagi mana-mana sektor, jenis pekerjaan dan kawasan wilayah atau bagi mana-mana orang atau golongan orang; (d) permulaan kuat kuasa perintah gaji minimum dan tarikh yang berlainan bagi permulaan kuat kuasa perintah gaji minimum bagi sektor, jenis pekerjaan dan kawasan wilayah yang berlainan, atau bagi orang atau golongan orang yang berlainan; dan (e) perkara lain yang berhubungan dengan gaji minimum, termasuk pelaksanaan kadar dan liputan gaji minimum yang disyorkan. (2) Kerajaan boleh, selepas menimbangkan syor itu— (a) bersetuju dengan syor itu; atau (b) mengarahkan Majlis untuk mengkaji semula syor itu dalam tempoh yang ditentukan oleh Kerajaan dan membuat syor baru. (3) Jika Kerajaan mengarahkan Majlis untuk mengkaji semula syor itu dan membuat syor baru di bawah perenggan (2)(b), seksyen 21 dan subseksyen (1) hendaklah terpakai. (4) Kerajaan boleh, selepas menimbangkan syor baru yang dibuat menurut subseksyen (3)— (a) bersetuju dengan syor baru itu; atau (b) tidak bersetuju dengan syor baru itu dan menentukan perkara yang dinyatakan dalam perenggan (1)(a) hingga (e).
