Construction Industry Payment and Adjudication Act 2012 s 18
(1) The adjudicator, in making the adjudication decision in relation to costs of the adjudication proceedings shall order the costs to follow the event and shall fix the quantum of costs to be paid. (2) Subsection (1) shall prevail over any agreement made by the parties prior to the commencement of the adjudication proceedings by which one party agrees to pay the other party’s costs or bear the adjudicator’s fees and expenses.
Kos prosiding adjudikasi
(1) Adjudikator, dalam membuat keputusan adjudikasi berhubung dengan kos prosiding adjudikasi hendaklah memerintahkan kos supaya mengikut keadaan dan hendaklah menetapkan kuantum kos yang perlu dibayar itu. (2) Subseksyen (1) hendaklah mengatasi mana-mana perjanjian yang dibuat oleh pihak-pihak sebelum permulaan prosiding adjudikasi yang dengannya satu pihak bersetuju untuk membayar kos pihak yang satu lagi atau menanggung fi dan perbelanjaan adjudikator.
