s 196 Appointment and remuneration of liquidator

(1) The High Court, where a winding up order is made in respect of an institution pursuant to section 193, shall appoint as liquidator such person as the Bank may specify in its application and shall specify that the remuneration of the liquidator shall be determined by the Bank. (2) On an application by the Bank, the High Court shall appoint as liquidator such person as the Bank may specify in its application— (a) to fill a vacancy; or (b) to remove and replace a liquidator appointed under subsection (1).

Pelantikan dan saraan pelikuidasi

(1) Mahkamah Tinggi, jika suatu perintah penggulungan dibuat berkenaan dengan institusi menurut seksyen 193, hendaklah melantik sebagai pelikuidasi mana-mana orang sebagaimana yang ditentukan oleh Bank dalam permohonannya dan hendaklah menentukan bahawa saraan pelikuidasi itu hendaklah diputuskan oleh Bank. (2) Atas suatu permohonan oleh Bank, Mahkamah Tinggi hendaklah melantik sebagai pelikuidasi mana-mana orang sebagaimana yang ditentukan oleh Bank dalam permohonannya— (a) untuk mengisi suatu kekosongan; atau (b) untuk memecat dan menggantikan pelikuidasi yang dilantik di bawah subseksyen (1).
