s 39 Power of investigation

(1) An animal welfare officer shall have all the powers necessary to carry out an investigation of the commission of an offence under this Act or any subsidiary legislation made under this Act. (2) For the purpose of subsection (1), the Criminal Procedure Code [Act 593] shall apply and an animal welfare officer shall have all the powers as provided for under the Criminal Procedure Code to carry out an investigation.

Kuasa penyiasatan

(1) Seseorang pegawai kebajikan haiwan hendaklah mempunyai segala kuasa yang perlu untuk menjalankan penyiasatan pelakuan sesuatu kesalahan di bawah Akta ini atau mana-mana perundangan subsidiari yang dibuat di bawah Akta ini. (2) Bagi maksud subseksyen (1), Kanun Tatacara Jenayah [Akta 593] hendaklah terpakai dan seseorang pegawai kebajikan haiwan hendaklah mempunyai segala kuasa yang diperuntukkan di bawah Kanun Tatacara Jenayah untuk menjalankan penyiasatan.
