s 24 Temporary practising certificate

(1) A non-Malaysian citizen who has been practising an Allied Health Profession outside Malaysia may apply to the Council to practise in Malaysia if he fulfils the following qualifications: (a) he is in Malaysia for the exclusive purpose of teaching, to conduct research or to undergo postgraduate study in such field of allied health in such institution approved by the Council; (b) he possesses expertise in such field of allied health which the Council considers necessary for the advancement of healthcare in Malaysia; or (c) he has a contract of employment with the public service. (2) An application by a non-Malaysian citizen to practise shall be in such manner as may be determined by the Council and such application shall be accompanied by the prescribed fee. (3) Where the Council approves the application under subsection (2), the Registrar shall issue to the non-Malaysian citizen a temporary practising certificate and make an entry in the Register. (4) No non-Malaysian citizen shall practise any Allied Health Profession unless he is issued with a temporary practising certificate. (5) The temporary practising certificate shall be valid for one year from the date the certificate is issued. (6) The Council may revoke the temporary practising certificate if the holder of such certificate fails to abide by the conditions and restrictions specified in the certificate. (7) The temporary practising certificate may be renewed on an application to the Council and accompanied by the prescribed fee. (8) The temporary practising certificate shall specify the address of the principal place of practice and all other places of practice of the holder of a temporary practising certificate and any change in any address shall be notified by the holder of such temporary practising certificate within thirty days of such change to the Registrar and the Registrar shall endorse such change. (9) Any non-Malaysian citizen who practises as an allied health practitioner without a temporary practising certificate commits an offence and shall, upon conviction, be liable to a fine not exceeding fifty thousand ringgit or to imprisonment for a term not exceeding two years or to both. (10) The holder of a temporary practising certificate shall, while the certificate remains in force and subject to the conditions and restrictions specified in the certificate, be deemed to be a registered practitioner for the purposes of Part V and Part VI.

Perakuan amalan sementara

(1) Seorang bukan warganegara Malaysia yang sedang mengamalkan suatu Profesion Kesihatan Bersekutu di luar Malaysia boleh memohon kepada Majlis untuk beramal di Malaysia jika dia memenuhi kelayakan yang berikut: (a) dia berada di Malaysia semata-mata bagi tujuan mengajar, menjalankan penyelidikan atau mengikuti kursus lepasan ijazah dalam bidang kesihatan bersekutu di institusi yang diluluskan oleh Majlis; (b) dia memiliki kemahiran dalam bidang kesihatan bersekutu yang difikirkan perlu oleh Majlis bagi kemajuan penjagaan kesihatan di Malaysia; atau (c) dia mempunyai kontrak kerja dengan perkhidmatan awam. (2) Suatu permohonan oleh bukan warganegara Malaysia untuk beramal hendaklah mengikut cara yang ditentukan oleh Majlis dan permohonan itu hendaklah disertakan dengan fi yang ditetapkan. (3) Jika Majlis meluluskan permohonan di bawah subseksyen (2), Pendaftar hendaklah mengeluarkan kepada bukan warganegara Malaysia itu suatu perakuan amalan sementara dan membuat catatan dalam Daftar. (4) Tiada seorang pun bukan warganegara Malaysia boleh mengamalkan mana-mana Profesion Kesihatan Bersekutu melainkan jika dia telah diberikan perakuan amalan sementara. (5) Perakuan amalan sementara adalah sah bagi tempoh satu tahun dari tarikh perakuan itu dikeluarkan. (6) Majlis boleh membatalkan perakuan amalan sementara jika pemegang perakuan itu gagal mematuhi syarat dan sekatan yang dinyatakan dalam perakuan itu. (7) Perakuan amalan sementara boleh diperbaharui melalui permohonan kepada Majlis dan disertakan dengan fi yang ditetapkan. (8) Perakuan amalan sementara hendaklah menyatakan alamat tempat amalan utama dan semua tempat amalan lain pemegang perakuan amalan sementara dan apa-apa perubahan kepada mana-mana alamat hendaklah diberitahu oleh pemegang perakuan amalan sementara dalam tempoh tiga puluh hari dari tarikh perubahan itu kepada Pendaftar dan Pendaftar hendaklah mengendors perubahan itu. (9) Mana-mana bukan warganegara Malaysia yang beramal sebagai pengamal kesihatan bersekutu tanpa perakuan amalan sementara melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi lima puluh ribu ringgit atau dipenjarakan selama tempoh tidak melebihi dua tahun atau kedua-duanya. (10) Pemegang perakuan amalan sementara hendaklah, selagi perakuan itu terus berkuat kuasa dan tertakluk kepada syarat dan sekatan yang dinyatakan dalam perakuan itu, disifatkan sebagai seorang pengamal berdaftar bagi maksud Bahagian V dan Bahagian VI.
