s 30 Duty to refer patient to medical or dental practitioner

(1) A registered practitioner shall refer his patient to a medical practitioner or dental practitioner if the patient is experiencing an acute medical emergency or if the ailment or condition of the patient is beyond the skill, competency or expertise of the registered practitioner. (2) An acute medical emergency is a medical condition which is sudden, unanticipated and urgent, requiring immediate medical or surgical evaluation or treatment for the relief of acute, pain and suffering of the patient. (3) A registered practitioner shall clearly and carefully explain to and advise the patient or the guardian or representative of the patient of the duty to refer the patient to a medical or dental practitioner so as to enable the patient or the guardian or representative of the patient to make an informed decision as to whether to refuse to be referred or not. (4) Notwithstanding subsection (1), if the patient or the guardian or representative of such patient, by written notice, duly consents not to be referred, then the practitioner shall not be obliged to refer the patient to a medical or dental practitioner. (5) If a registered practitioner has contravened subsection (1) the Council may— (a) impose a stop order pursuant to section 51; or (b) revoke the registration of such practitioner.

Kewajipan untuk merujukkan pesakit kepada pengamal perubatan atau pengamal pergigian

(1) Pengamal berdaftar hendaklah merujukkan pesakitnya kepada pengamal perubatan atau pengamal pergigian jika pesakit itu mengalami suatu kecemasan perubatan yang akut atau jika penyakit atau keadaan pesakit itu di luar kemahiran, kelayakan atau kepakaran pengamal berdaftar itu. (2) Kecemasan perubatan yang akut ialah suatu keadaan kesihatan yang berlaku secara tiba-tiba, tidak dijangka dan mencemaskan, yang memerlukan penilaian perubatan atau pembedahan atau rawatan untuk melegakan akut, sakit dan penderitaan pesakit. (3) Pengamal berdaftar hendaklah menerangkan secara jelas dan dengan berhati-hati dan menasihatkan pesakit atau penjaga atau wakil pesakit mengenai kewajipan untuk merujukkan pesakit kepada pengamal perubatan atau pengamal pergigian bagi membolehkan pesakit atau penjaga atau wakil pesakit menggunakan maklumat itu untuk membuat keputusan sama ada menolak untuk dirujukkan atau tidak. (4) Walau apapun subseksyen (1), jika pesakit atau penjaga atau wakil pesakit, melalui notis bertulis, bersetuju seperti yang sepatutnya untuk tidak dirujuk, pengamal tidak diwajibkan untuk merujukkan pesakit kepada pengamal perubatan atau pengamal pergigian. (5) Jika seseorang pengamal berdaftar melanggar subseksyen (1) Majlis boleh— (a) mengenakan perintah berhenti menurut seksyen 51; atau (b) membatalkan pendaftaran pengamal itu.
