s 35 Mandatory practice standards in governance and practice codes

(1) The Council shall prescribe the mandatory practice standards, for the purpose of the governance and practice codes which are to be complied which by registered practitioners. (2) A registered practitioner shall comply with the mandatory practice standards in governance and practice codes. (3) Non-compliance with the mandatory practice standards in governance and practice codes shall subject the registered practitioner to disciplinary action and revocation of registration. (4) Prior to determining the mandatory practice standards, the Council shall conduct a public engagement as to the scope of the mandatory practice standards. (5) The public engagement shall set out the views of the Council in respect of the mandatory practice standards and provide interested parties not less than forty-five days to submit written responses to the Council. (6) At the conclusion of the public engagement process, the Council shall cause to be published a public engagement report and the approved draft mandatory practice standards. (7) All mandatory practice standards shall be published and recorded in register. (8) All mandatory practice standards may be varied, amended, modified or revoked by the Council and such variation, amendment, modification or revocation shall be published and recorded in register. (9) The Council shall, prior to any variation, amendment, modification or revocation of mandatory practice standards becoming effective undertake a public engagement in respect of the variation, amendment, modification or revocation except where such variation, amendment, modification or revocation is due to typographical errors only. (10) The whole or part of the governance and practice code shall be invalid to the extent of any conflict or inconsistency with the mandatory practice standards.

Piawai amalan mandatori dalam kod tadbir urus dan kod amalan

(1) Majlis hendaklah menetapkan piawai amalan mandatori, bagi maksud kod tadbir urus dan kod amalan yang hendaklah dipatuhi oleh pengamal berdaftar. (2) Pengamal berdaftar hendaklah mematuhi piawai amalan mandatori dalam kod tadbir urus dan kod amalan. (3) Ketidakpatuhan terhadap piawai amalan mandatori dalam kod tadbir urus dan kod amalan boleh menyebabkan pengamal berdaftar dikenakan tindakan tatatertib dan pembatalan pendaftaran pengamal berdaftar. (4) Sebelum menentukan piawai amalan mandatori, Majlis hendaklah menjalankan perundingan awam mengenai skop piawai amalan mandatori. (5) Perundingan awam itu hendaklah menyatakan pandangan Majlis berkenaan dengan piawai amalan mandatori dan memperuntukkan masa tidak kurang daripada empat puluh lima hari untuk pihak yang berminat mengemukakan maklum balas bertulis kepada Majlis. (6) Pada penutup proses perundingan awam, Majlis hendaklah menyebabkan supaya disiarkan laporan perundingan awam itu dan draf piawai amalan mandatori yang diluluskan. (7) Segala piawai amalan mandatori hendaklah disiarkan dan dicatat dalam daftar. (8) Segala piawai amalan mandatori boleh diubah, dipinda, diubah suai atau dibatalkan oleh Majlis dan apa-apa ubahan, pindaan, ubah suaian atau pembatalan hendaklah disiarkan dan dicatat dalam daftar. (9) Majlis hendaklah, sebelum apa-apa ubahan, pindaan, ubah suaian atau pembatalan piawai amalan mandatori berkuat kuasa, menjalankan perundingan awam berkenaan dengan ubahan, pindaan, ubah suaian atau pembatalan itu melainkan jika ubahan, pindaan, ubah suaian atau pembatalan itu disebabkan oleh kesilapan menaip atau tatabahasa sahaja. (10) Keseluruhan atau sebahagian kod tadbir urus dan amalan adalah tidak sah setakat apa-apa percanggahan atau ketidakselarasan antara kod dengan piawai amalan mandatori.
