s 69 Power to require information and conduct inspection

(1) For the purpose of obtaining information as to whether any self-employed person has made payment of contribution or any other information related to the claim of benefit under this Act, the Director General or the Inspector may, by notice in writing, require any person who he has reasonable grounds to believe that the person has any information or document, or is capable of giving any evidence, that is relevant to the payment of contribution or to the claim of benefit under this Act― (a) to provide such information to the Director General or the Inspector within such time as may be specified in the notice; or (b) to attend personally before the Director General or the Inspector and to produce any book, account, record and other documents including electronic records for examination as the Director General or the Inspector deems necessary. (2) Where it appears to any Magistrate upon written information on oath and after such enquiry as he thinks necessary that there is reasonable grounds to believe that in any place or building there is any book, account, record or other documents including electronic records the production of which has been required under subsection (1) but has not been produced, such Magistrate may issue a warrant authorizing the Director General or any person named therein, with or without assistance, enter the place or building, by force if necessary, and inspect the place or building, seize, take possession of and detain any such book, account, record or other documents including electronic records. (3) Any person who fails to comply with subsection (1) commits an offence and shall, on conviction, be liable to a fine not exceeding ten thousand ringgit or to imprisonment for a term not exceeding two years or to both.

Kuasa untuk menghendaki maklumat dan menjalankan pemeriksaan

(1) Bagi maksud memperoleh maklumat mengenai sama ada mana-mana orang bekerja sendiri telah membuat bayaran caruman atau apa-apa maklumat lain berhubung dengan tuntutan bagi faedah di bawah Akta ini, Ketua Pengarah atau Pemeriksa boleh, melalui notis bertulis, menghendaki mana-mana orang yang dia mempunyai alasan yang munasabah untuk mempercayai bahawa orang itu mempunyai apa-apa maklumat atau dokumen, atau berupaya untuk memberikan apa-apa keterangan, yang berkaitan dengan bayaran caruman atau tuntutan bagi faedah di bawah Akta ini― (a) untuk memberikan apa-apa maklumat kepada Ketua Pengarah atau Pemeriksa dalam masa yang dinyatakan dalam notis itu; atau (b) untuk hadir sendiri di hadapan Ketua Pengarah atau Pemeriksa dan untuk mengemukakan apa-apa buku, akaun, rekod dan dokumen lain termasuk rekod elektronik untuk diperiksa sebagaimana yang difikirkan perlu oleh Ketua Pengarah atau Pemeriksa. (2) Jika ternyata pada mana-mana Majistret atas maklumat bertulis bersumpah dan selepas apa-apa siasatan yang difikirkannya perlu bahawa terdapat alasan yang munasabah untuk mempercayai bahawa di mana-mana tempat atau bangunan terdapat apa-apa buku, akaun, rekod atau dokumen lain termasuk rekod elektronik yang pengemukaannya dikehendaki di bawah subseksyen (1) tetapi tidak dikemukakan, Majistret itu boleh mengeluarkan waran yang memberi kuasa kepada Ketua Pengarah atau mana-mana orang yang dinamakan dalam waran itu, dengan atau tanpa bantuan, untuk memasuki tempat atau bangunan itu, sekiranya perlu dengan kekerasan, dan memeriksa tempat atau bangunan itu, menyita, mengambil milikan dan menahan apa-apa buku, akaun, rekod atau dokumen lain itu termasuk rekod elektronik. (3) Mana-mana orang yang tidak mematuhi subseksyen (1) melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi sepuluh ribu ringgit atau dipenjarakan selama tempoh tidak melebihi dua tahun atau kedua-duanya.
