Access to Biological Resources and Benefit Sharing Act 2017 s 31
s 31 Notification for application of patent
(1) Any person applying for a patent, whether in or outside Malaysia, in relation to a biological resource or traditional knowledge associated with a biological resource accessed shall notify to the National Competent Authority in writing within thirty days from the date of the application.
(2) Any person who contravenes subsection (1) commits an offence and shall, on conviction, be liable—
(a) where such person is an individual, to a fine not exceeding one hundred thousand ringgit or to imprisonment for a term not exceeding seven years or to both; and
(b) where such person is a body corporate, to a fine of not exceeding five hundred thousand ringgit.

Pemberitahuan bagi permohonan paten
(1) Mana-mana orang yang memohon bagi suatu paten, sama ada di dalam atau di luar Malaysia, berhubung dengan sumber biologi atau pengetahuan tradisi yang berkaitan dengan sumber biologi yang diakses hendaklah memberitahu Pihak Berkuasa Kompeten Kebangsaan secara bertulis dalam tempoh tiga puluh hari dari tarikh permohonan itu.
(2) Mana-mana orang yang melanggar subseksyen (1) melakukan suatu kesalahan dan boleh, apabila disabitkan—
(a) jika orang itu ialah orang perseorangan, didenda tidak melebihi satu ratus ribu ringgit atau dipenjarakan selama tempoh tidak melebihi tujuh tahun atau kedua-duanya; dan
(c) jika orang itu ialah suatu pertubuhan perbadanan, didenda tidak melebihi lima ratus ribu ringgit.
