s 33 Posting and confidential information
(1) A copy of the permit including the information in the permit sent to the National Competent Authority under this Act shall, at the same time, be posted on the website of the clearing house mechanism by any authorized person.
(2) The information under subsection (1) shall not be posted if it is classified as confidential as determined by the relevant Competent Authority.
(3) For the purposes of subsection (2), information is classified to be confidential if—
(a) it is culturally sensitive; or
(b) disclosed, it may—
(i) damage a person’s commercial interests;
(ii) result in a risk to the biodiversity; or
(iii) be detrimental to the national interest.
(4) A n y d e t e r m i n a t i o n a s t o c o n f i d e n t i a l i t y u n d e r subparagraph (3)(b)(i) shall be made upon the application of the applicant.

Paparan dan maklumat rahsia
(1) Suatu salinan permit termasuk maklumat yang terkandung dalam permit itu yang dihantar kepada Pihak Berkuasa Kompeten Kebangsaan di bawah Akta ini hendaklah, pada masa yang sama, dipaparkan di laman web mekanisme pusat penjelasan oleh mana-mana orang yang diberi kuasa.
(2) Maklumat di bawah subseksyen (1) hendaklah tidak boleh dipaparkan jika maklumat itu dikelaskan sebagai rahsia sebagaimana yang ditentukan oleh Pihak Berkuasa Kompeten yang berkaitan.
(3) Bagi maksud subseksyen (2), maklumat dikelaskan sebagai rahsia jika—
(a) maklumat itu sensitif mengikut kebudayaan; atau
(b) didedahkan, maklumat itu boleh—
(i) merosakkan kepentingan komersial seseorang;
(ii) mengakibatkan risiko terhadap biodiversiti; atau
(iii) memudaratkan kepentingan negara.
(4) Apa-apa penentuan kerahsiaan di bawah subperenggan (3)(b)(i) hendaklah dibuat atas permohonan oleh pemohon.
