Access to Biological Resources and Benefit Sharing Act 2017 s 47

s 47 Cost of holding seized biological resource, etc.

Where any biological resource, conveyance, machinery, contrivance, equipment, book, record, document or other article seized or surrendered under this Act is held in the custody of the Competent Authority pending completion of any proceedings in respect of an offence under this Act, the cost of holding it in custody shall, in the event of any person being convicted of such offence, be a debt due to the Competent Authority or Government, as the case may be, by such person and shall be recoverable accordingly.

Kos memegang sumber biologi, dsb., yang disita

Jika mana-mana sumber biologi, pengangkut, jentera, peralatan, kelengkapan, buku, rekod, dokumen atau benda lain yang disita atau diserahkan di bawah Akta ini dipegang dalam jagaan Pihak Berkuasa Kompeten sementara menunggu penyelesaian apa-apa prosiding berkenaan dengan suatu kesalahan di bawah Akta ini, kos untuk memegangnya dalam jagaan hendaklah, sekiranya mana-mana orang didapati bersalah atas kesalahan itu, menjadi hutang yang kena dibayar kepada Pihak Berkuasa Kompeten atau Kerajaan, mengikut mana-mana yang berkenaan, oleh orang itu dan bolehlah didapatkan dengan sewajarnya.
