s 51 Compounding of offences

(1) The Minister may, with the approval of the Public Prosecutor, make regulations prescribing— (a) any offence under this Act and any regulations made under the Act that may be compounded; (b) the criteria for compounding such offence; and (c) the method and procedure for compounding such offence. (2) The Competent Authority may, with the consent in writing of the Public Prosecutor, compound any offence committed by any person under this Act and prescribed to be a compoundable offence by making a written offer to the person suspected to have committed the offence to compound the offence upon payment to the Competent Authority of an amount of money not exceeding fifty per centum of the amount of maximum fine for that offence within such time as may be specified in his written offer. (3) An offer under subsection (2) may be made at any time after the offence has been committed but before any prosecution for it has been instituted. (4) If the amount specified in the offer is not paid within the time specified in the offer or such extended time as the Competent Authority may grant, prosecution for the offence may be instituted at any time after that against the person to whom the offer was made. (5) Where an offence has been compounded under subsection (2), no prosecution shall be instituted in respect of the offence against the person to whom the offer to compound was made, and any biological resource, conveyance, machinery, contrivance, equipment, book, record, document or other article seized in connection with the offence may be forfeited or released by the Competent Authority in accordance with sections 44 and 46, subject to such terms and conditions as the Competent Authority thinks fit.

Pengkompaunan kesalahan

(1) Menteri boleh, dengan kelulusan Pendakwa Raya, membuat peraturan-peraturan bagi menetapkan— (a) mana-mana kesalahan di bawah Akta ini dan apa-apa peraturan-peraturan yang dibuat di bawah Akta yang boleh dikompaun; (b) kriteria bagi mengkompaun kesalahan; dan (c) kaedah dan tatacara mengkompaun kesalahan. (2) Pihak Berkuasa Kompeten boleh, dengan keizinan bertulis Pendakwa Raya, mengkompaun apa-apa kesalahan yang dilakukan oleh mana-mana orang di bawah Akta ini dan yang ditetapkan sebagai suatu kesalahan yang boleh dikompaun dengan membuat suatu tawaran bertulis kepada orang yang disyaki telah melakukan kesalahan itu untuk mengkompaun kesalahan itu apabila dibayar kepada Pihak Berkuasa Kompeten suatu amaun yang tidak melebihi lima puluh peratus amaun denda maksimum bagi kesalahan itu dalam masa yang dinyatakan dalam tawaran bertulisnya. (3) Suatu tawaran di bawah subseksyen (2) boleh dibuat pada bila-bila masa selepas kesalahan itu dilakukan tetapi sebelum apa-apa pendakwaan baginya dimulakan. (4) Jika amaun yang dinyatakan dalam tawaran itu tidak dibayar dalam masa yang dinyatakan dalam tawaran itu atau dalam apa-apa masa lanjutan yang diberikan oleh Pihak Berkuasa Kompeten, pendakwaan bagi kesalahan itu boleh dimulakan pada bila-bila masa selepas itu terhadap orang yang kepadanya tawaran itu dibuat. (5) Jika suatu kesalahan telah dikompaun di bawah subseksyen (2), tiada pendakwaan boleh dimulakan berkenaan dengan kesalahan itu terhadap orang yang kepadanya tawaran untuk mengkompaun itu dibuat, dan mana-mana sumber biologi, pengangkut, jentera, peralatan, kelengkapan, buku, rekod, dokumen atau benda lain disita berkaitan dengan kesalahan itu boleh dilucuthakkan atau dilepaskan oleh Pihak Berkuasa Kompeten di bawah seksyen 44 dan 46, tertakluk kepada apa-apa terma dan syarat yang difikirkan patut oleh Pihak Berkuasa Kompeten.
