s 35 Claim for refund of service tax in relation to bad debt
(1) Any person who is, or has ceased to be, a registered person may make a claim to the Director General for a refund of the whole or any part of any service tax paid by him in respect of taxable services if—
(a) the whole or any part of the service tax payable to such person has been written off in his accounts as bad debts; and
(b) the Director General is satisfied that all reasonable efforts have been made by such person to recover the service tax.
(2) Where the person who makes a claim for a refund under subsection (1) in relation to a bad debt—
(a) has not received any payment in respect of the provision of taxable services, such person may make a claim for a refund of the whole of the service tax paid; or
(b) has received any payment in respect of the provision of taxable services, such person may make a claim for the difference between the service tax paid and amount calculated in accordance with the following formula:
A x C B
where A is the payment received in respect of the provision of such taxable services;
B is the value of such taxable services plus service tax payable on such taxable services; and
C is the service tax payable on such taxable services.
(3) The person referred to in subsection (1) may make a claim for a refund of the whole or any part of any service tax in relation to the bad debt within six years from the date the service tax is
paid by him and the Director General may refund the whole or any part of the service tax after being satisfied that the person has properly established the claim.
(4) For the purposes of this section, “bad debt” means the outstanding amount of the payment in respect of the provision of taxable services including the service tax which is due to a person who is, or has ceased to be, a registered person but has not been paid to, and is irrecoverable by, the person.

Tuntutan bagi pembayaran balik cukai perkhidmatan berhubung dengan hutang lapuk
(1) Mana-mana orang yang merupakan, atau telah terhenti menjadi, orang berdaftar boleh membuat tuntutan kepada Ketua Pengarah bagi pembayaran balik keseluruhan atau mana-mana bahagian apa-apa cukai perkhidmatan yang dibayar olehnya berkenaan dengan perkhidmatan bercukai jika—
(a) keseluruhan atau mana-mana bahagian cukai perkhidmatan yang kena dibayar kepada orang itu telah dihapus kira dalam akaunnya sebagai hutang lapuk; dan
(b) Ketua Pengarah berpuas hati bahawa segala usaha yang munasabah telah dibuat oleh orang itu untuk mendapatkan balik cukai perkhidmatan itu.
(2) Jika orang yang membuat tuntutan bagi pembayaran balik di bawah subseksyen (1) berhubung dengan hutang lapuk—
(a) tidak menerima apa-apa bayaran berkenaan dengan pemberian perkhidmatan bercukai itu, orang itu boleh membuat tuntutan bagi bayaran balik keseluruhan cukai perkhidmatan yang telah dibayar itu; atau
(b) telah menerima apa-apa bayaran berkenaan pemberian perkhidmatan bercukai itu, orang itu boleh membuat tuntutan bagi perbezaan antara cukai perkhidmatan yang telah dibayar dengan amaun yang dikira mengikut formula yang berikut:

iaitu A ialah bayaran yang diterima berkenaan dengan pemberian perkhidmatan bercukai itu;
B ialah nilai perkhidmatan bercukai itu ditambah dengan cukai perkhidmatan yang kena dibayar atas perkhidmatan bercukai itu; dan
C ialah cukai perkhidmatan yang kena dibayar atas perkhidmatan bercukai itu.
(3) Orang yang disebut dalam subseksyen (1) boleh membuat tuntutan bagi pembayaran balik keseluruhan atau mana-mana bahagian apa-apa cukai perkhidmatan berhubung dengan hutang lapuk dalam masa enam tahun dari tarikh cukai perkhidmatan dibayar olehnya dan Ketua Pengarah boleh membayar balik keseluruhan atau mana-mana bahagian cukai perkhidmatan itu selepas berpuas hati bahawa orang itu telah membuktikan tuntutan itu dengan sewajarnya.
(4) Bagi maksud seksyen ini, “hutang lapuk” ertinya amaun belum jelas bagi bayaran berkenaan dengan pemberian perkhidmatan bercukai termasuk cukai perkhidmatan yang terhutang kepada seseorang yang merupakan, atau telah terhenti menjadi, orang berdaftar tetapi tidak dibayar kepada, dan tidak boleh didapatkan balik oleh, orang itu.
