Trademarks Act 2019 s 155

s 155 Exercise of discretionary power

Where any discretionary power is given to the Registrar by this Act, he shall not exercise that power adversely to the applicant for registration of trademark or the registered proprietor in question without, if duly required to do so within the prescribed period, giving to the applicant an opportunity of being heard.

Menjalankan kuasa budi bicara

Jika apa-apa kuasa budi bicara diberikan kepada Pendaftar oleh Akta ini, Pendaftar tidak boleh menjalankan kuasa itu bertentangan dengan pemohon bagi pendaftaran cap dagangan atau tuan punya berdaftar yang dipersoal tanpa, jika dikehendaki dengan sewajarnya untuk berbuat demikian dalam tempoh yang ditetapkan, memberi pemohon itu suatu peluang untuk didengar.
