s 63 Co-proprietorship of registered trademark

(1) Where a registered trademark is granted to two or more persons jointly, each of them shall be entitled, subject to any agreement to the contrary, to an equal undivided share in the registered trademark. (2) This section applies where two or more persons are co-proprietors of a registered trademark under subsection (1). (3) Subject to subsection (4) or any agreement to the contrary, each co-proprietor shall be entitled, by himself or his agents, to do for his own benefit and without the consent of or the need to account to the other, any act which would otherwise amount to an infringement of the registered trademark. (4) One co-proprietor shall not without the consent of the other— (a) grant a licence to use the registered trademark; or (b) assign or charge his share in the registered trademark. (5) Infringement proceedings may be brought by any co-proprietor, but he may not, without leave of the Court, proceed with the action unless the other, or each of the others, is either joined as a plaintiff or added as a defendant. (6) A co-proprietor who is thus added as a defendant shall not be made liable for any costs in the action unless he takes part in the proceedings. (7) Nothing in this subsection affects the granting of interlocutory relief on the application of a single co-proprietor. (8) Nothing in this section affects the mutual rights and obligations of trustees or personal representatives, or their rights and obligations as such.

Ketuanpunyaan bersama cap dagangan berdaftar

(1) Jika cap dagangan berdaftar diberikan kepada dua atau lebih orang secara bersesama, setiap orang adalah berhak, tertakluk kepada apa-apa perjanjian yang bertentangan, kepada suatu bahagian yang tak dipecahkan yang sama rata bagi cap dagangan berdaftar itu. (2) Seksyen ini terpakai jika dua atau lebih orang ialah tuan punya bersama suatu cap dagangan berdaftar di bawah subseksyen (1). (3) Tertakluk kepada subseksyen (4) atau apa-apa perjanjian yang bertentangan, setiap tuan punya bersama hendaklah berhak, dengan sendirinya atau melalui ejennya, untuk melakukan bagi faedahnya sendiri dan tanpa persetujuan atau keperluan untuk bertanggungjawab kepada yang lain, apa-apa perbuatan yang selainnya akan terjumlah kepada pelanggaran cap dagangan berdaftar. (4) Seorang tuan punya bersama tidak boleh tanpa persetujuan yang lain— (a) memberikan lesen untuk menggunakan cap dagangan berdaftar; atau (b) menyerah hak atau menggadaikan sahamnya dalam cap dagangan berdaftar. (5) Prosiding pelanggaran boleh dibawa oleh mana-mana tuan punya bersama, tetapi dia tidak boleh, tanpa kebenaran Mahkamah, meneruskan tindakan itu melainkan jika yang lain, atau setiap yang lain, sama ada dimasukkan sebagai plaintif atau ditambahkan sebagai defendan. (6) Seorang tuan punya bersama yang kemudiannya ditambah sebagai defendan tidak bertanggungan ke atas apa-apa kos dalam tindakan melainkan jika dia mengambil bahagian dalam prosiding itu. (7) Tiada apa-apa jua dalam subseksyen ini yang menyentuh pemberian relief interlokutori atas permohonan seorang tuan punya bersama tunggal. (8) Tiada apa-apa jua dalam seksyen ini yang menyentuh hak dan kewajipan bersama para pemegang amanah atau wakil peribadi, atau hak dan kewajipan mereka.
