s 59 Release of thing seized

(1) If any book, account, document, computerized data, signboard, card, letter, pamphlet, leaflet, notice, facility, apparatus, equipment, device, thing or matter has been seized under this Act, the authorized officer who effected the seizure may, after referring to the Public Prosecutor, release the book, account, document, computerized data, signboard, card, letter, pamphlet, leaflet, notice, facility, apparatus, equipment, device, thing or matter to the person as he determines to be lawfully entitled to the book, account, document, computerized data, signboard, card, letter, pamphlet, leaflet, notice, facility, apparatus, equipment, device, thing or matter if he is satisfied that the book, account, document, computerized data, signboard, card, letter, pamphlet, leaflet, notice, facility, apparatus, equipment, device, thing or matter is not liable to forfeiture under this Act and is not otherwise required for the purposes of any proceedings under this Act, or for the purpose of any prosecution under any other law, and in such event neither the officer effecting the seizure, nor the Government or any person acting on behalf of the Government, shall be liable to any proceedings by any person if the seizure and the release of the book, account, document, computerized data, signboard, card, letter, pamphlet, leaflet, notice, facility, apparatus, equipment, device, thing or matter had been effected in good faith. (2) A record in writing shall be made by the officer effecting the release of any book, account, document, computerized data, signboard, card, letter, pamphlet, leaflet, notice, facility, apparatus, equipment, device, thing or matter under subsection (1) specifying in detail the circumstances of, and the reason for, the release, and he shall send a copy of the record to the Public Prosecutor within seven days of the release.

Pelepasan benda yang disita

(1) Jika apa-apa buku, akaun, dokumen, data berkomputer, papan tanda, kad, surat, risalah, lembaran, notis, kemudahan, radas, kelengkapan, peranti, benda atau bahan telah disita di bawah Akta ini, pegawai diberi kuasa yang membuat penyitaan itu boleh, selepas merujuk kepada Pendakwa Raya, melepaskan buku, akaun, dokumen, data berkomputer, papan tanda, kad, surat, risalah, lembaran, notis, kemudahan, radas, kelengkapan, peranti, benda atau bahan yang disita kepada orang sebagaimana yang ditentukan olehnya sebagai berhak secara sah kepada buku, akaun, dokumen, data berkomputer, papan tanda, kad, surat, risalah, lembaran, notis, kemudahan, radas, kelengkapan, peranti, benda atau bahan itu jika dia berpuas hati bahawa buku, akaun, dokumen, data berkomputer, papan tanda, kad, surat, risalah, lembaran, notis, kemudahan, radas, kelengkapan, peranti, benda atau bahan itu tidak boleh dilucuthakkan di bawah Akta ini dan tidak dikehendaki selainnya bagi maksud apa-apa prosiding di bawah Akta ini, atau bagi maksud pendakwaan di bawah mana-mana undang-undang lain, dan dalam hal sedemikian pegawai yang membuat penyitaan itu, atau Kerajaan atau mana-mana orang yang bertindak bagi pihak Kerajaan, tidak boleh dikenakan apa-apa prosiding oleh mana-mana orang jika penyitaan dan pelepasan buku, akaun, dokumen, data berkomputer, papan tanda, kad, surat, risalah, lembaran, notis, kemudahan, radas, kelengkapan, peranti, benda atau bahan itu telah dibuat dengan suci hati. (2) Suatu rekod secara bertulis hendaklah dibuat oleh pegawai yang membuat pelepasan apa-apa buku, akaun, dokumen, data berkomputer, papan tanda, kad, surat, risalah, lembaran, notis, kemudahan, radas, kelengkapan, peranti, benda atau bahan di bawah subseksyen (1) yang menyatakan secara terperinci hal keadaan dan sebab bagi pelepasan itu, dan dia hendaklah menghantar suatu salinan rekod itu kepada Pendakwa Raya dalam tempoh tujuh hari daripada pelepasan itu.
