Cross-Border Insolvency Act 2026 s 22

s 22 Protection of creditors and other interested persons

(1) In granting or refusing any relief under section 19 or 21, or in modifying or terminating any relief under subsection (3) or subsection 20(6), the Court shall be satisfied that the interests of the creditor, including the creditor in Malaysia, any secured creditor or party to a hire-purchase agreement, and any other interested person, including the debtor where appropriate, are adequately protected. (2) The Court may impose such conditions on the grant of relief under section 19 or 21 as the Court deems appropriate, including requiring the foreign representative to furnish security for the due performance of his functions. (3) The Court may, on the application of the foreign representative or any person affected by the relief granted under section 19 or 21, or on its own motion, modify or terminate the relief.

Perlindungan pemiutang dan orang berkepentingan lain

(1) Dalam memberikan atau menolak apa-apa relief di bawah seksyen 19 atau 21, atau dalam mengubah suai atau menamatkan apa-apa relief di bawah subseksyen (3) atau subseksyen 20(6), Mahkamah hendaklah berpuas hati bahawa kepentingan pemiutang, termasuk pemiutang di Malaysia, mana-mana pemiutang bercagar atau pihak kepada perjanjian sewa beli, dan mana-mana orang berkepentingan lain, termasuk penghutang jika bersesuaian, dilindungi dengan secukupnya. (2) Mahkamah boleh mengenakan apa-apa syarat terhadap pemberian relief di bawah seksyen 19 atau 21 sebagaimana yang difikirkan sesuai oleh Mahkamah, termasuk menghendaki wakil asing untuk memberikan jaminan bagi pelaksanaan wajar fungsinya. (3) M a h k a m a h b o l e h , a t a s p e r m o h o n a n w a k i l a s i n g atau mana-mana orang yang terjejas dengan relief yang diberikan di bawah seksyen 19 atau 21, atau atas usulnya sendiri, mengubah suai atau menamatkan relief itu.
