s 81 Grant of letters of administration to the Corporation in cases of delay

In the following cases, namely: (a) where, after the expiration of six months from the death of a deceased person, no application has been made for probate or letters of administration to his estate; (b) where any such application, though made within the said six months, has not within that period been proceeded with, or has been withdrawn or refused; (c) where a receiver may be appointed under section 45, but it appears that the appointment would not be a sufficient protection for the estate; or (d) where, after the death of a last surviving executor or administrator of a deceased person’s estate, six months have elapsed and no application for the representation of the estate has been made, letters of administration with or without the will annexed may be granted to the Corporation, or to such other person as the Court thinks fit: Provided that nothing in this section shall be construed so as to prevent the Corporation from applying for or being granted letters of administration of the estate of a deceased person with or without the will annexed before the expiration of a period of six months of the death of the deceased. 82-85. Dalam hal-hal yang berikut, iaitu: (a) jika, selepas habis tempoh enam bulan dari keptabiran. pusakanya; (b) jika apa-apa permohonan sedemikian, walaupun telah dibuat dalam masa enam bulan tersebut. telah tidak diteruskan, atau telah ditarik balik atau ditolak dalam tempoh itu; (c) jika seorang penerima boleh dilantik di bawah seksyen 45, tetapi adalah didapati bahawa perlantikan itu tidak boleh memberi perlindungan yang secukupnya kepada harta pusaka itu; (d) jika, selepas kematian wasi atau pentadbir menakat yang terakhir bagi harta pusaka seseorang orang sudah mati, enam bulan telah luput dan tiada permohonan untuk mendapatkan perwakilan bagi harta pusaka itu dibuat, difikirkan patut oleh Mahkamah: Kuasa Pegawai Pentadbir Pusaka untuk memohon mendapatkan pemberian apabila penerima pemberian tidak mengambil emaberia entadbira
