SEC. 35. If any person shall construct at his own expense works for the diversion and distribution of water to the public for irrigation purposes, the rates to lie charged by such person for such service shall be determined from time to time by the Secretary of Commerce and Police: Provided, however, That such rates shall not be changed oftener than once in ten years.
