Union market surveillance and control of pyrotechnic articles entering the Union market

Article 38

1.   Member States shall take all appropriate measures to ensure that pyrotechnic articles may be placed on the market only if, when properly stored and used for their intended purpose, they do not endanger the health and safety of persons. 2.   Article 15(3) and Articles 16 to 29 of Regulation (EC) No 765/2008 shall apply to pyrotechnic articles. 3.   Member States shall inform the Commission annually about their market surveillance activities.
