This Act may be cited as the Lembaga Kemajuan Shorttitle Ternakan Negara (Dissolution) Act 1983 and shall come and commence- into force on a date to be appointed by the Minister by ment. notification in the Gazette. 2. [S. 5-8] Transfer of property.
(1) All lands that immediately before the commencement of this Act were vested in the Lembaga shall, on thecommencement of this Act, vest in the Federal Lands Commissioner for the purpose of the Government. 2) All property and assetsother than land that immediately before the commencement of this Act were vested in the Lembaga or in anyperson on its behalf shall, on the commencement of this Act, vest in the Government. Transfer of fund.
All moneys standing in, or due to be paid to, the Lembaga shall, on the commencement of this Act, be transferred to, and be vested with, the Government. Existing contracts.
All deeds, bonds, agreements, instruments and working arrangements subsisting immediately before the commencement of this Act and affecting any of the property transferred under section 5,shall be in full force and effect against or in favour of the Government and enforceable as tully and effectually as if, instead of the Lembaga or any person acting on its behalf, the Government had been named therein or had been a party thereto. Continuance 8. (1) Any civil proceeding or cause of action pending procedings. or existing immediately before the commencement of this Actby or against the Lembaga or any person acting on its behalf may be continued or instituted by or against the Government as it might have been by or against the Lembaga or such person if this Act had not been passed
(2) Any appeal brought or any leave to appeal applied for, on or after the commencement of this Act against a decision given before the commencement of this Act in any legal proceedings to which the Lembaga was a party may be brought by or against the Government.
[S. 9-10] LEMBAGA KEMAJUAN TERNAKAN NEGARA (DISSOLUTION)
(1) Apa-apa prosiding sivil atau kausa tindakan yang menunggu keputusan atau sedia ada sebelum sahaja mula berkuatkuasanya Akta ini oleh atau terhadap Lembaga atau mana-mana orang yang bertindak bagi pihaknya bolehlah diteruskan atau dimulakan oleh atau terhadap Kerajaan sama seperti yang boleh diteruskan atau dimulakan oleh atau terhadap Lembaga atau orang sedemikian itu seolah-olah Akta ini telah tidak diluluskan.
[S. 8-10] LEMBAGA KEMAJUAN TERNAKAN NEGARA (PEMBUBARAN)
(2) Apa-apa kebenaran untuk merayu yang dipohonkan, pada atau solepas mula berkuatkuasanya Akta ini terhadap kedibawa oleh atau terhadap Kerajaan. mula berkuatkuasanya Akta ini hendaklah, sehingga dipinda atau dibatal oleh pihak berkuasa berkenaan ang mempunyai kuasa berbuat demikian, terus ber cuatkuasa dan hendaklah ditafsirkan seolah-olah Akt ini telah tidak diluluskan: Dengan syarat bahawa apa-apa sebutan di dalamnya nengenal Lembaga, melainkan jika konteksnya meng lendaki makna yang lain, hendaklah ditafsirkan sebagai sebutan mengenai Kerajaan dan ungkapan yang membawa erti sebutan sedemikian hendaklah ditafsirkan sewajarnya.
(1) Subject to the provisions of this Act, all written Continuance laws, orders, rules and regulations affecting or for the oflaws, etc. protection of the Lembaga and in force immediately before the commencement of this Act shall, until amended or revoked by the appropriate authority having power so to do, continue in force and be construed as if this Act had not been passed: Provided that any references therein to the Lembaga, unless the context otherwise requires, shall be construed as references to the Government and expressions importing such a reference shall be construed accordingly.
(1) It any difficulty or anomaly arises in connection Prevention with the implementation of the provisions of this Act, or diomalies. the Minister may by order make such modification therein as may appear to him necessary for removing or preventing such diffculty or anomaly.
(2) The Minister shall not exercise the powers conferred by subsection (1) after the expiration of three years from the commencement of this Act.
