s 8 Duties and responsibilities of members, etc.

(1) A member of the Lembaga, a member of the Investment Panel, a member of the committee of the Lembaga, officers and servants of the Lembaga shall— (a) at all times, exercise his powers in accordance with this Act for a proper purpose and in good faith in the best interest of the Tabung; and (b) exercise his duties and responsibilities with reasonable care, skill and diligence based on the knowledge, skills and experience which may reasonably be expected of a person having the same duties and responsibilities. (2) A member of the Lembaga, a member of the Investment Panel, a member of the committee of the Lembaga, officers and servants of the Lembaga who has breached or failed to comply, has contributed to the breach or non-compliance or has contravenes any provision of this Act may, for any loss or damage caused by his act or omission, be held personally liable.

Kewajipan dan tanggungjawab anggota, dsb.

(1) Anggota Lembaga, anggota Panel Pelaburan, anggota jawatankuasa Lembaga, pegawai dan pekhidmat Lembaga hendaklah— (a) pada setiap masa, menjalankan kuasanya mengikut Akta ini bagi maksud yang sepatutnya dan dengan suci hati demi kepentingan Tabung; dan (b) menjalankan kewajipan dan tanggungjawabnya dengan ketelitian, kemahiran dan ketekunan yang munasabah berdasarkan pengetahuan, kemahiran dan pengalaman yang semunasabahnya dijangka daripada seorang yang mempunyai kewajipan dan tanggungjawab yang sama. (2) Anggota Lembaga, anggota Panel Pelaburan, anggota jawatankuasa Lembaga, pegawai dan pekhidmat Lembaga yang telah memungkiri atau gagal mematuhi, telah menyumbang kepada kemungkiran atau ketidakpatuhan atau telah melanggar mana-mana peruntukan Akta ini boleh, bagi apa-apa kerugian atau kerosakan disebabkan oleh tindakan atau peninggalannya, dipertanggungjawabkan secara sendiri.
