s 17 Cancellation or suspension of instructor’s registration

(1) The Registrar may cancel or suspend the registration of an instructor— (a) if he is satisfied that the instructor— (i) has ceased to provide instruction in any form of martial arts to which the registration relates; (ii) has improperly obtained his instructor’s certificate contrary to the provisions of this Act or any regulations thereunder; (iii) is no longer a fit and proper person to continue to be registered as an instructor; or (iv) is contravening or has contravened any of the provisions of this Act or the regulations made thereunder; or (b) if he considers it in the public interest to do so. (2) The Registrar shall, before cancelling or suspending the registration of an instructor under subsection (1), give the instructor concerned a notice in writing of his intention to do so, specifying a date, not less than fourteen days after the date of the notice, upon which such cancellation or suspension shall be made and calling upon the instructor to show cause to the Registrar why such registration should not be cancelled or suspended. (3) If before the date referred to in subsection (2) the instructor fails to show cause to the Registrar why his registration should not be cancelled or suspended, his registration shall be cancelled or suspended but if the instructor shows cause, the Registrar shall decide and shall inform the instructor in writing of his decision. (4) If an instructor, after showing cause, is aggrieved by the decision of the Registrar he may within fourteen days after the receipt of the decision of the Registrar appeal to the Minister charged with the responsibility for registration of societies in writing whose decision shall be final. (5) Notwithstanding that an appeal had been made the decision of the Registrar shall take effect until it is reversed or varied by such Minister.

Pembatalan atau penggantungan pendaftaran pengajar

(1) Pendaftar boleh membatalkan atau menggantung pendaftaran seseorang pengajar— (a) jika dia berpuas hati bahawa pengajar itu— (i) telah berhenti memberi pengajaran dalam manamana gaya seni mempertahankan diri yang berhubungan dengan pendaftaran itu; (ii) telah dengan tidak sepatutnya memperoleh perakuan pengajarnya berlawanan dengan peruntukan Akta ini atau mana-mana peraturan di bawahnya; (iii) tidak lagi merupakan seorang yang layak dan sesuai untuk terus didaftarkan sebagai seorang pengajar; atau (iv) melanggar atau telah melanggar mana-mana peruntukan Akta ini atau peraturan yang dibuat di bawahnya; atau (b) jika dia berpendapat adalah demi kepentingan awam untuk berbuat demikian. (2) Pendaftar hendaklah, sebelum membatalkan atau menggantung pendaftaran seorang pengajar di bawah subseksyen (1), memberi pengajar yang berkenaan suatu notis secara bertulis tentang niatnya untuk berbuat demikian, menyatakan suatu tarikh, tidak kurang daripada empat belas hari selepas tarikh notis itu, bila pembatalan atau penggantungan itu akan dibuat dan meminta pengajar itu menunjukkan sebab kepada Pendaftar mengapa pendaftaran itu tidak patut dibatalkan atau digantung. (3) Jika sebelum tarikh yang disebut dalam subseksyen (2), pengajar tidak menunjukkan sebab kepada Pendaftar mengapa pendaftarannya tidak patut dibatalkan atau digantung, pendaftarannya hendaklah dibatalkan atau digantung tetapi jika pengajar menunjukkan sebab, Pendaftar hendaklah memutuskan dan hendaklah memberitahu pengajar secara bertulis tentang keputusannya. (4) Jika seseorang pengajar, selepas menunjukkan sebab, terkilan dengan keputusan Pendaftar, dia boleh dalam masa empat belas hari selepas menerima keputusan Pendaftar itu, merayu secara bertulis kepada Menteri yang bertanggungjawab bagi pendaftaran pertubuhan dan keputusan Menteri adalah muktamad. (5) Walaupun rayuan telah dibuat, keputusan Pendaftar hendaklah berkuat kuasa sehingga keputusan itu diakas atau diubah oleh Menteri itu.
