s 154 Objection to attachment

(1) If any person whose property has been attached under the provisions of this Part disputes the propriety of the attachment he may apply to the High Court, in the case of the attachment of a holding, or the Magistrate’s Court in the case of the attachment of movable property, for an order to stay the proceedings, and such Court after making such enquiry as may be necessary shall make such order on the premises as may be just. (2) No application shall be entertained by any court unless the applicant has deposited with the local authority the amount of the arrear with interest and costs.

Bantahan terhadap tahanan

(1) Jika seseorang yang telah ditahan hartanya di bawah peruntukan Bahagian ini mempertikaikan kepatutan tahanan itu dia boleh memohon kepada Mahkamah Tinggi jika harta yang ditahan itu ialah suatu pegangan, atau kepada Mahkamah Majistret jika harta yang ditahan itu ialah harta alih, untuk suatu perintah menggantung tindakan itu, dan mahkamah itu selepas menjalankan apa-apa penyiasatan yang perlu hendaklah membuat apa-apa perintah yang patut mengenai hal yang tersebut di atas. (2) Tiada apa-apa permohonan boleh dilayani oleh mana-mana Mahkamah melainkan jika pemohon telah mendepositkan dengan pihak berkuasa tempatan amaun tunggakan itu berserta bunga dan kos.
