s 33 Determination of development charge
(1) Before granting planning permission for any development, the local planning authority shall determine whether a development charge is payable in respect of the development and, if payable, the amount thereof, and shall serve on the applicant for planning permission a notice in the prescribed form demanding payment of the amount.
(2) The determination by the local planning authority of the amount of the development charge shall be final and shall not be subject to appeal or review in any court.

Penentuan caj pemajuan
(1) Sebelum memberikan kebenaran merancang untuk mana-mana pemajuan, pihak berkuasa perancang tempatan hendaklah menentukan sama ada caj pemajuan kena dibayar berkenaan dengan pemajuan itu dan, jika kena dibayar, menentukan amaunnya, dan hendaklah menyampaikan kepada pemohon untuk kebenaran merancang suatu notis dalam bentuk yang ditetapkan menuntut amaun itu dibayar.
(2) Penentuan oleh pihak berkuasa perancang tempatan itu mengenai amaun caj pemajuan itu adalah muktamad dan tidak boleh tertakluk kepada rayuan atau kajian semula dalam mana-mana mahkamah.
