Town and Country Planning Act 1976 s 38

s 38 Declaration of development areas

(1) At any time after the local planning authority has adopted a local plan for a special area, the local planning authority may, by notification in the State Gazette, declare the area or any part thereof to be a development area. (2) Upon an area being declared to be a development area, it shall be the duty of the local planning authority to acquire, by purchase or by compulsory acquisition under the Land Acquisition Act 1960, all alienated lands situated within the area, and to develop the area in accordance with the local plan.

Perisytiharan kawasan pemajuan

(1) Pada bila-bila masa selepas pihak berkuasa perancang tempatan menerima suatu rancangan tempatan untuk suatu kawasan khas, pihak berkuasa perancang tempatan boleh, melalui pemberitahuan dalam Warta Negeri, mengisytiharkan kawasan itu atau mana-mana daripada bahagiannya sebagai suatu kawasan pemajuan. (2) Apabila sesuatu kawasan diisytiharkan sebagai suatu kawasan pemajuan, menjadi kewajipan pihak berkuasa perancang tempatan itu mengambil, melalui pembelian atau pengambilan paksa di bawah Akta Pengambilan Tanah 1960, semua tanah beri hak milik yang terletak di dalam kawasan itu, dan memajukan kawasan itu mengikut rancangan tempatan itu.
