s 37 Registration conclusive
In all legal proceedings relating to a trade mark registered in the Register (including applications under section 45) the original registration of the trade mark under this Act shall, after the expiration of seven years from the date thereof, be taken to be valid in all respects unless it is shown—
(a) that the original registration was obtained by fraud;
(b) that the trade mark offends against section 14; or
(c) that the trade mark was not, at the commencement of the proceedings, distinctive of the goods or services of the registered proprietor,
except that this section shall not apply to a trade mark registered under the repealed Ordinances and incorporated in the Register pursuant to subsection 6(3) until after the expiration of three years from the commencement of this Act.

Pendaftaran muktamad
Dalam semua prosiding di sisi undang-undang berkenaan dengan sesuatu cap dagangan yang didaftarkan dalam Daftar (termasuk permohonan di bawah seksyen 45) pendaftaran asal cap dagangan itu di bawah Akta ini hendaklah, selepas tamat tujuh tahun dari tarikh pendaftaran asal itu, dikira sebagai sah mengenai semua perkara melainkan jika dibuktikan—
(a) bahawa pendaftaran asal cap dagangan itu telah didapatkan secara fraud;
(b) bahawa cap dagangan itu bersalahan dengan peruntukan seksyen 14; atau
(c) bahawa pada permulaan pembicaraan itu cap dagangan itu telah tidak distinktif akan barang-barang atau perkhidmatan tuan punya berdaftar itu,
kecuali bahawa seksyen ini tidaklah terpakai bagi sesuatu cap dagangan yang didaftarkan di bawah Ordinan yang dimansuhkan dan yang disatukan dalam Daftar menurut subseksyen 6(3) sehingga selepas tamat tempoh tiga tahun dari mula berkuat kuasanya Akta ini.
