Trustee Act 1949 s 63

s 63 Power to relieve trustee from personal liability

If it appears to the Court that a trustee, whether appointed by the Court or otherwise, is or may be personally liable for any breach of trust, whether the transaction alleged to be a breach of trust occurred before or after the commencement of this Act, but has acted honestly and reasonably, and ought fairly to be excused for the breach of trust and for omitting to obtain the directions of the Court in the matter in which he committed such breach, then the Court may relieve him either wholly or partly from personal liability for the same.

Kuasa melepaskan pemegang amanah daripada liabiliti sendiri

Jika pada hemat Mahkamah bahawa seseorang pemegang amanah, sama ada yang dilantik oleh Mahkamah atau selainnya, adalah atau mungkin bertanggungan sendiri kerana sesuatu pecah amanah, sama ada transaksi yang dikatakan sebagai pecah amanah itu berlaku sebelum atau selepas mula berkuatkuasanya Akta ini, tetapi dia telah bertindak dengan suci hati dan munasabahnya, dan seharusnya dimaafkan kerana pecah amanah itu dan kerana tidak mendapat arahan Mahkamah mengenai perkara yang terhadapnya dia melakukan pemecahan itu, maka Mahkamah boleh melepaskan pemegang amanah itu sama ada kesemuanya atau sebahagiannya daripada liabiliti sendiri kerana pecah amanah itut.
