s 46 Notice requiring purchase of land in certain cases

(1) Without prejudice to the operation of any written law for the time being in force relating to the acquisition of land, a registered proprietor of land— (a) for the development of whose land planning permission has been refused under section 22 on the grounds that the land is indicated in the development plan, whether expressly or by implication, as land intended for a public purpose and who claims that, by reason of the refusal, the land is incapable of reasonable beneficial use; or (b) who claims that, by reason of compliance with a requisition notice in respect of his land served on him under section 30, the land is incapable of reasonable beneficial use, may, in the prescribed manner, serve on the Commissioner a purchase notice in the prescribed form, requiring his interest in the land to be purchased in accordance with this section. (2) There shall be served with the purchase notice a statement of the facts and reasons to justify the claims in the notice, together with copies of any available documents, including affidavits that may furnish proof of the facts and reasons. (3) The Commissioner shall investigate the claim made in every purchase notice served under subsection (1) and, if it is satisfied that the notice is in the prescribed form and has been prepared and served in the prescribed manner, shall submit the notice to the Minister together with the statement and any other documents served with the notice and— (a) in the case of a purchase notice of a person claiming under paragraph (1)(a), a detailed report concerning the refusal of planning permission giving rise to the claim, a statement of the specific purpose for which the land is intended, and a statement of the opinion of the Commissioner as to whether the land is capable of reasonable beneficial use; and (b) in the case of a purchase notice of a person claiming under paragraph (1)(b), details of the requisition notice giving rise to the claim and a statement of the opinion of the Commissioner as to whether the land is capable of reasonable beneficial use. (4) If the Commissioner is not satisfied that the purchase notice is in the prescribed form or has been prepared or served in the prescribed manner, he shall reject the purchase notice, but without prejudice to the service of another purchase notice. (5) The Minister, after considering the purchase notice and all other matters submitted by the Commissioner under subsection (3) shall— (a) if the Minister is satisfied that the land to which the purchase notice relates is capable of reasonable beneficial use, reject the purchase notice; or (b) if the Minister is not satisfied that the land to which the purchase notice relates is capable of reasonable beneficial use or is satisfied that the land is not capable of such use, direct the Commissioner to initiate steps towards the acquisition of the land in accordance with the Land Acquisition Act 1960 [Act 486]. (6) For the purposes of the Land Acquisition Act 1960— (a) any land intended to be acquired pursuant to this section shall be deemed to be needed by the Commissioner; and (b) the land shall be deemed to be needed for the purpose referred to in paragraph 3(b) of the said Act.

Notis menghendaki pembelian tanah dalam hal tertentu

(1) Tanpa menyentuh perjalanan mana-mana undang-undang bertulis yang pada masa itu berkuat kuasa berkenaan dengan pengambilan tanah, tuan punya berdaftar tanah― (a) yang tidak diberi kebenaran perancangan di bawah seksyen 22 untuk memajukan tanahnya atas alasan bahawa tanah itu adalah ditetapkan dalam pelan pembangunan sama ada secara nyata atau tersirat, sebagai tanah yang dicadangkan bagi maksud awam dan yang menuntut bahawa, oleh sebab penolakan itu, tanah itu tidak munasabah boleh digunakan dengan berfaedah; atau (b) yang menuntut bahawa, oleh sebab mematuhi sesuatu notis pengambilan berkenaan dengan tanahnya yang disampaikan kepadanya di bawah seksyen 30, tanah itu tidak munasabah boleh digunakan dengan berfaedah, boleh, mengikut cara yang ditetapkan, menyampaikan kepada Datuk Bandar suatu notis pembelian dalam borang yang ditetapkan, menghendaki supaya kepentingannya mengenai tanah itu dibeli mengikut seksyen ini. (2) Maka hendaklah disampaikan bersama notis pembelian suatu pernyataan tentang fakta dan sebab bagi mematutkan tuntutan dalam notis itu, serta salinan apa-apa dokumen yang ada, termasuk affidavit, yang boleh memberi bukti tentang fakta dan sebabnya. (3) Datuk Bandar hendaklah menyiasat tuntutan yang dibuat dalam tiap-tiap notis pembelian yang disampaikan di bawah subseksyen (1) dan, jika dia berpuas hati bahawa notis itu adalah dalam borang yang ditetapkan dan telah disediakan dan disampaikan mengikut cara yang ditetapkan, hendaklah menghantar notis itu kepada Menteri bersama-sama dengan pernyataan dan apa-apa dokumen lain yang disampaikan bersama dengan notis itu dan― (a) mengenai sesuatu notis pembelian seseorang yang menuntut di bawah perenggan (1)(a), suatu laporan lengkap berkenaan dengan penolakan kebenaran perancangan yang menyebabkan tuntutan itu timbul, suatu pernyataan tentang maksud tertentu yang dicadangkan untuk tanah itu, dan suatu pernyataan tentang pendapat Datuk Bandar sama ada tanah itu munasabah boleh digunakan dengan berfaedah; dan (b) mengenai sesuatu notis pembelian seseorang yang menuntut di bawah perenggan (1)(b), butir-butir notis permintaan itu yang menyebabkan tuntutan itu timbul dan suatu pernyataan tentang pendapat Datuk Bandar sama ada tanah itu munasabah boleh digunakan dengan berfaedah. (4) Jika Datuk Bandar tidak berpuas hati bahawa notis pembelian itu adalah dalam borang yang ditetapkan atau disediakan atau disampaikan mengikut cara yang ditetapkan, dia hendaklah menolak notis pembelian itu, tetapi tanpa menyentuh penyampaian suatu notis pembelian yang lain. (5) Menteri, selepas menimbangkan notis pembelian itu dan semua perkara lain yang dihantar oleh Datuk Bandar di bawah subseksyen (3) hendaklah― (a) jika Menteri berpuas hati bahawa tanah yang dimaksudkan oleh notis pembelian itu adalah munasabah boleh digunakan dengan berfaedah, menolak notis pembelian itu; atau (b) jika Menteri tidak berpuas hati bahawa tanah yang dimaksudkan oleh notis pembelian itu adalah munasabah boleh digunakan dengan berfaedah atau berpuas hati bahawa tanah itu tidak boleh digunakan sedemikian mengarahkan Datuk Bandar untuk memulakan langkah untuk mengambil tanah itu mengikut peruntukan Akta Pengambilan Tanah 1960 [Akta 486]. (6) Bagi maksud Akta Pengambilan Tanah 1960— (a) mana-mana tanah yang dicadang untuk diambil menurut seksyen ini hendaklah disifatkan sebagai diperlukan oleh Datuk Bandar; dan (b) tanah itu hendaklah disifatkan sebagai diperlukan bagi maksud yang disebut dalam perenggan (3)(b) Akta itu.
