s 54 Amendment, cancellation and surrender of compulsory licence

(1) Upon the request of the owner of the patent or of the beneficiary of the compulsory licence, the Registrar may amend the decision granting the compulsory licence to the extent that new facts justify such amendment. (2) Upon the request of the owner of the patent, the Registrar shall cancel the compulsory licence— (a) if the ground for the grant of the compulsory licence no longer exists; (b) if the beneficiary of the compulsory licence has, within the time limit fixed in the decision granting the licence, neither begun the working of the patented invention in Malaysia nor made serious preparations towards such working; (c) if the beneficiary of the compulsory licence does not respect the scope of the licence as fixed in the decision granting the licence; (d) if the beneficiary of the compulsory licence is in arrears of the payment due, according to the decision granting the licence. (3) The beneficiary of the compulsory licence may surrender the licence by a written declaration submitted to the Registrar who shall record the surrender in the Register, publish it, and notify the owner of the patent. (4) The surrender shall take effect from the date the Patent Registration Office receives the declaration of the surrender and such declaration shall not be withdrawn.

Pindaan, pembatalan dan penyerahan lesen wajib

(1) Atas permintaan pemunya paten atau benefisiari bagi lesen wajib, Pendaftar boleh meminda keputusan yang memberi lesen wajib itu setakat mana fakta baharu mematutkan pindaan itu. (2) Atas permintaan pemunya paten, Pendaftar hendaklah membatalkan lesen wajib— (a) jika alasan untuk memberi lesen wajib itu tidak lagi wujud; (b) jika benefisiari lesen wajib telah, dalam had tempoh yang ditetapkan dalam keputusan yang memberi lesen itu, tidak memulai kerja reka cipta yang dipaten di Malaysia atau tidak dibuat persediaan yang serius terhadap kerja berkenaan; (c) jika benefisiari bagi lesen wajib tidak mematuhi skop lesen itu sebagaimana ditetapkan dalam keputusan yang memberi lesen itu; (d) jika benefisiari bagi lesen wajib mempunyai tunggakan pembayaran yang kena dibayar, menurut keputusan yang memberi lesen itu. (3) Benefisiari bagi lesen wajib boleh menyerahkan lesen itu melalui suatu akuan bertulis yang dikemukakan kepada Pendaftar yang akan merekodkan penyerahan itu dalam Daftar, menyiarkannya, dan memberitahu pemunya paten itu. (4) Penyerahan hendaklah berkuat kuasa dari tarikh Pejabat Pendaftaran Paten menerima akuan penyerahan itu dan akuan itu tidak boleh ditarik balik.
