s 43 Appeal to Minister

(1) Where any person is aggrieved by any decision of or any revocation or any condition imposed by any person or authority empowered under this Act to grant any licence, permit, or approval, he may within twenty-one days from the date of receipt of the decision or licence, permit or approval, appeal to the Minister. (2) On appeal, the Minister may receive such evidence as he may consider necessary and may confirm, annul or vary the decision or conditions made by or imposed by the person or authority granting the licence, permit or approval. (3) For the purpose of providing any advice or assistance that the Minister may require to enable him to consider any appeal under subsection (1), the Minister may appoint such officer or officers of technical and other appropriate skills, as he may deem necessary and such officer or officers shall have powers to inspect any premises to enable him or them to effectively advise or assist the Minister.

Rayuan kepada Menteri

(1) Jika mana-mana orang terkilan dengan apa-apa keputusan atau apa-apa pembatalan atau apa-apa syarat yang dikenakan oleh mana-mana orang atau pihak berkuasa yang diberi kuasa di bawah Akta ini untuk memberi apa-apa lesen, permit atau kelulusan, dia boleh dalam tempoh dua puluh satu hari dari tarikh penerimaan keputusan atau lesen, permit atau kelulusan itu merayu kepada Menteri. (2) Atas rayuan, Menteri boleh menerima apa-apa keterangan sebagaimana difikirkannya perlu dan boleh mengesahkan, memansuhkan atau mengubah keputusan atau syarat yang dibuat atau dikenakan oleh orang atau pihak berkuasa yang memberikan lesen, permit atau kelulusan itu. (3) Bagi maksud memberi apa-apa nasihat atau bantuan yang mungkin diperlukan oleh Menteri bagi membolehkannya menimbangkan apa-apa rayuan di bawah subseksyen (1), Menteri boleh melantik pegawai atau pegawai-pegawai yang mempunyai kemahiran teknikal dan kemahiran lain yang sesuai, sebagaimana difikirkannya perlu dan pegawai atau pegawai-pegawai itu hendaklah mempunyai kuasa memeriksa mana-mana premis untuk membolehkannya atau mereka menasihati atau membantu Menteri dengan berkesannya.
