s 99 Special order in case of small estate

(1) If it appears that, having regard to the station in life of a minor and to the value of his property and to all the circumstances of the case, it would be expedient that the capital property of the minor be made available for his maintenance, education, or advancement in such manner as to avoid the expense of making application to the Court, the Court may, instead of appointing a guardian of the property of the minor, order that all the property of the minor, of whatsoever description, be placed in the hands of a person to be appointed by the Court, with full power to deal with and apply the property for the purpose aforesaid in his sole and uncontrolled discretion; and in that case the receipt of the person appointed shall be a good discharge to any person making any payment or transfer of any property to him on behalf of the minor. (2) Any persons appointed under subsection (1) may be ordered by the Court to render an account of his dealings with the minor’s estate. (3) The Court may for any sufficient reason discharge any order, or revoke any appointment, made under subsection (1), and may appoint another person with the same power or such greater or lesser power as may appear advisable, or may appoint a guardian of the minor’s property.

(1) Jika memandang kepada taraf kehidupan Perintah khas kanak-kanak itu dan kepada nilai hartanya dan juga mengenai kepada segala hal keadaan kes yang berkenaan adalah barta kecil. didapati bermanfaat supaya harta modal kanak-kanak itu digunakan bagi menanggung nafkah, pelajaran, atau kemajuannya dengan cara yang boleh mengelakkan belanja bagi membuat permohonan kepada Mahkamah, maka Mahkamah, darıpada melantık seorang penjaga bagı harta kanak-kanak ıtu, boleh memerintahkan supaya segala harta kanak-kanak itu, dari apa Jua jenis pun, diletakkan dalam tangan seseorang yang akan dilantik oleh Mahkamah, dengan kuasa penuh untuk membuat apa-apa urusan dan untuk menggunakan harta itu bagi maksud yang tersebut di atas menurut budi bicaranya sendiri bebas dari apa-apa kawalan; dan dalam hal yang demikian resit dari orang yang dilantik itu adalah menjadi akuan penyelesaian yang sewajarnya bagi sesiapa jua yang membuat apa-apa pembayaran atau pindahmilik apa-apa harta kepadanya bagi pihak kanak-kanak itu. 1) boleh diperintahkan (2) Seshoraneerintan dioikhankamsuleksyer mengemukakan suatu akaun mengenai urusan-urusan yang dibuat olehnya mengenai harta kanak-kanak itu. (3) Mahkamah boleh, kerana sesuatu sebab yang memadai, membatalkan apa-apa perintah, atau memansuhkan apa-apa perlantikan, yang dibuat di bawah dengan memberi kepadanya kuasa yang sama atau apa-apa kuasa yang lebih besar atau lebih kecil yang difikirkannya patut, atau boleh melantik seorang [Bah, VII, S. 100-102] kamah untuk mendapatkan pendapat, nasihat, atau budi bicaranya atas apa-apa soal mengenai pengurusan atau pentadbiran harfa kanak-kanak itu.
