s 13 Closing order

(1) Where a fire-hazard abatement notice has been served on any person, if— (a) that person fails to comply with any of the requirements of the notice within the time specified therein; and (b) the fire-hazard, although abated since the service of the notice, is, in the opinion of the Director General, likely to recur in the same premises, and the Director General is of the opinion that it is necessary to prohibit any use of the premises that may materially increase the likelihood of a fire or the danger to life or property resulting from the outbreak of a fire in or on the premises or other premises, the Director General may, by way of a complaint, apply to a court for a closing order. (2) Upon receipt of a complaint and an application for a closing order under subsection (1), the court shall serve a notice in Form C in the First Schedule on the owner or occupier of the premises, or on both, calling on them to show cause why a closing order should not be made; and if cause is not shown by either the owner or occupier or both, the court may make such an order. (3) A closing order shall be in Form D in the First Schedule and shall be served on both the owner and occupier of the premises in question. (4) Upon the application by the owner or occupier of premises, or upon being informed by the Director General, the court, if satisfied that the premises in respect of which a closing order is in force have been rendered suitable for the use specified in the order, may revoke the closing order. (5) Any person who without reasonable excuse knowingly contravenes a closing order shall be guilty of an offence and shall, on conviction, be liable to a fine not exceeding five thousand ringgit or to imprisonment for a term not exceeding three years or to both and shall also be liable to a further fine of one hundred ringgit for each day during which the offence is continued after the conviction.

(1) Jika suatu notis menghapuskan bahaya kebakaran telah disampaikan kepada mana-mana orang, sekiranya— (a) orang itu tidak mematuhi apa-apa kehendak notis itu dalam masa yang dinyatakan di dalamnya; dan (b) bahaya kebakaran itu, walaupun telah dihapuskan sejak penyampaian notis itu, mungkin pada pendapat Ketua Pengarah akan berulang di dalam premis yang sama, dan Ketua Pengarah berpendapat bahawa adalah perlu untuk melarang apa-apa penggunaan premis itu yang boleh secara materialnya meningkatkan kemungkinan berlakunya kebakaran atau bahaya kepada nyawa atau harta akibat daripada berlakunya kebakaran di dalam atau ke atas premis itu atau premis lain, Ketua Pengarah boleh, dengan cara suatu aduan, memohon kepada mahkamah bagi suatu perintah tutup. (2) Apabila aduan dan permohonan bagi perintah tutup di bawah subseksyen (1) diterima, mahkamah hendaklah menyampaikan notis dalam Borang C dalam Jadual Pertama kepada pemunya atau penghuni premis itu, atau kedua-duanya, meminta mereka menunjukkan sebab kenapa suatu perintah tutup tidak patut dibuat; dan jika sebabnya tidak ditunjukkan oleh sama ada pemunya atau penghuni itu atau kedua-duanya, mahkamah boleh membuat perintah sedemikian. (3) Sesuatu perintah tutup hendaklah dalam Borang D dalam Jadual Pertama dan hendaklah disampaikan kepada kedua-dua pemunya dan penghuni premis yang berkenaan. (4) Atas permohonan pemunya atau penghuni premis, atau apabila diberitahu oleh Ketua Pengarah, mahkamah, jika berpuas hati bahawa premis yang berkenaan dengannya suatu perintah tutup sedang berkuat kuasa telah menjadi sesuai untuk kegunaan yang dinyatakan dalam perintah itu, boleh membatalkan perintah tutup itu. (5) Mana-mana orang yang tanpa alasan yang munasabah dengan disedarinya melanggar suatu perintah tutup melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi lima ribu ringgit atau dipenjarakan selama tempoh tidak melebihi tiga tahun atau kedua-duanya dan boleh juga dikenakan denda tambahan sebanyak satu ratus ringgit bagi setiap hari yang kesalahan itu berterusan selepas sabitan.
