s 4 Penalty for importing or exporting prohibited coin

(1) Any person who in contravention of any order made under this Act imports or exports or attempts to import or export any coin in such order specified shall be liable on conviction if the aggregate nominal value of such coin is five ringgit or more in the case of copper or bronze coin or twenty-five ringgit or more in the case of silver coin to a fine not exceeding two thousand ringgit, and any coin so imported or exported or attempted to be imported or exported in contravention of any such order shall be forfeited. (2) In any case in which it has been proved to the satisfaction of a court that coin has been exported in contravention of any such order such court may impose in addition to the fine authorized by this section a further penalty not exceeding the amount or value of the coin so found to have been exported. (3) This section shall not apply to any coin imported or exported under a licence in writing under the hand of the Minister of Finance or of any officer appointed in that behalf by the Minister of Finance. Every such licence shall specify the terms on which such coin may be imported or exported as the case may be. (4) Any person importing or exporting coin under any such licence shall be bound to comply with the terms in such licence specified, and any person importing or exporting coin in contravention of the terms of such licence shall be liable on conviction before the Magistrates’ Court to a fine not exceeding two thousand ringgit, and any coin imported or exported in contravention of the terms of such licence shall be forfeited. Subsection (2) shall apply in the case of any coin exported in contravention of the terms of any such licence. (5) If any person shall in contravention of any such order circulate or attempt to circulate any coin in such order specified, he shall be liable to a fine not exceeding fifty ringgit, and the coin shall be forfeited. (6) For the purposes of this section a person is not deemed to circulate coin who gives such coin to a banker or money-changer in exchange for other coin or for notes.

Penalti bagi mengimport atau mengeksport syiling larangan

(1) Mana-mana orang yang, dengan melanggar mana-mana perintah yang dibuat di bawah Akta ini, mengimport atau mengeksport atau cuba mengimport atau mengeksport mana-mana syiling yang dinyatakan dalam perintah sedemikian apabila disabitkan boleh didenda tidak melebihi dua ribu ringgit jika nilai nominal agregat syiling itu adalah lima ringgit atau lebih dalam hal syiling tembaga atau gangsa atau dua puluh lima ringgit atau lebih dalam hal syiling perak, dan apa-apa syiling yang diimport atau dieksport sedemikian atau cuba diimport atau dieksport dengan melanggar mana-mana perintah sedemikian hendaklah dirampas. (2) Dalam mana-mana kes yang telah dibuktikan dengan memuaskan hati mahkamah bahawa syiling telah dieksport dengan melanggar mana-mana perintah sedemikian, mahkamah tersebut boleh mengenakan sebagai tambahan kepada denda yang dibenarkan oleh seksyen ini suatu penalti tambahan yang tidak melebihi amaun atau nilai syiling yang didapati telah dieksport itu. Syiling (Import dan Eksport) (3) Seksyen ini tidaklah terpakai bagi mana-mana syiling yang telah diimport atau dieksport menurut sesuatu lesen bertulis yang ditandatangani oleh Menteri Kewangan atau mana-mana pegawai yang dilantik bagi maksud itu oleh Menteri Kewangan. Tiap-tiap lesen tersebut hendaklah menyatakan terma-terma yang menurutnya syiling itu boleh diimport atau dieksport, mengikut mana-mana yang berkenaan. (4) Mana-mana orang yang mengimport atau mengeksport syiling menurut mana-mana lesen itu adalah terikat untuk mematuhi terma yang dinyatakan dalam lesen itu, dan mana-mana orang yang mengimport atau mengeksport syiling dengan melanggar terma lesen itu boleh apabila disabitkan di hadapan Mahkamah Majistret boleh didenda tidak melebihi dua ribu ringgit, dan apa-apa syiling yang telah diimport dan dieksport dengan melanggar terma lesen itu hendaklah dirampas. Subseksyen (2) hendaklah terpakai dalam hal apa-apa syiling yang telah dieksport dengan melanggar terma mana-mana lesen itu. (5) Jika mana-mana orang dengan melanggar apa-apa perintah itu mengedar atau cuba mengedar apa-apa syiling yang dinyatakan dalam perintah sedemikian, maka dia boleh didenda tidak melebihi lima puluh ringgit, dan syiling itu hendaklah dirampas. (6) Bagi maksud seksyen ini seseorang tidaklah dianggap mengedarkan syiling jika dia memberi syiling itu kepada jurubank atau penukar wang sebagai pertukaran bagi syiling lain atau bagi wang kertas.
