Private Higher Educational Institutions Act 1996 s 93
s 93 Requirement as to premises
(1) The member of the board of directors, chief executive or any person responsible for the management of a private higher educational institution shall ensure that at all times, the premises of a private higher educational institution conform to such standards as may be prescribed under this Act.
(2) Notwithstanding subsection (1), if the Minister is satisfied with respect to any private higher educational institution that having regard to—
(a) the nature of its site;
(b) any existing buildings thereon; or
(c) other special circumstances affecting its premises,
it would be unreasonable in that case to require conformity with the requirements of the regulations in any particular respect, he may direct that the premises shall be deemed to conform to the prescribed standards if instead of conforming to the requirements of the
regulations in that respect the premises conform to such other requirements as may be specified in the direction.

Kehendak tentang premis
(1) Anggota lembaga pengarah, ketua eksekutif atau mana-mana orang yang bertanggungjawab bagi pengurusan sesuatu institusi
pendidikan tinggi swasta hendaklah memastikan bahawa pada sepanjang masa premis institusi pendidikan tinggi swasta itu mematuhi apa-apa piawai yang ditetapkan di bawah Akta ini.
(2) Walau apa pun subseksyen (1), jika Menteri berpuas hati berkenaan dengan mana-mana institusi pendidikan tinggi swasta bahawa setelah mengambil kira—
(a) keadaan tapaknya;
(b) mana-mana bangunan yang sedia ada di atas tapak itu; atau
(c) hal keadaan tertentu yang lain yang menyentuh premis itu,
adalah tidak munasabah dalam keadaan yang sedemikian untuk menghendaki institusi pendidikan tinggi swasta itu mematuhi keperluan dalam peraturan-peraturan mengenainya dalam apa-apa aspek tertentu, maka Menteri boleh mengarahkan supaya premis itu disifatkan mematuhi piawai yang ditetapkan jika sebagai ganti pematuhan kepada piawai yang ditetapkan itu, premis itu mematuhi apa-apa kehendak lain yang ditentukan dalam arahan itu.
