s 101 Burden of proof
(1) Whoever desires any court to give judgment as to any legal right or liability, dependent on the existence of facts which he asserts, must prove that those facts exist.
(2) When a person is bound to prove the existence of any fact, it is said that the burden of proof lies on that person.
ILLUSTRATIONS
(a) A desires a court to give judgment that B shall be punished for a crime which A says B has committed.
A must prove that B has committed the crime.
(b) A desires a court to give judgment that he is entitled to certain land in the possession of B by reason of facts which he asserts and which B denies to be true.
A must prove the existence of those facts.

Beban membuktikan
(1) Sesiapa yang berhasrat supaya mana-mana mahkamah memberikan penghakiman tentang apa-apa hak atau liabiliti
di sisi undang-undang, dengan bergantung pada kewujudan fakta yang ditegaskan olehnya, mestilah membuktikan bahawa fakta itu wujud.
(2) Apabila seseorang terikat untuk membuktikan kewujudan apa-apa fakta, dikatakan bahawa beban pembuktian terletak pada orang itu.
(a) A berhasrat supaya mahkamah memberikan penghakiman supaya B dihukum kerana suatu jenayah yang dikatakan oleh A telah dilakukan oleh B.
A mesti membuktikan bahawa B telah melakukan jenayah itu.
(b) A berhasrat supaya mahkamah memberikan penghakiman bahawa dia berhak ke atas tanah tertentu yang ada dalam milikan B atas sebab fakta yang ditegaskan oleh A sebagai benar tetapi dinafikan oleh B.
A mestilah membuktikan kewujudan fakta itu.
