s 4 Certificate to practise telemedicine

(1) An application for a certificate to practise telemedicine referred to in paragraph 3(1)(b) shall be made by a medical practitioner registered or licensed outside Malaysia through a fully registered medical practitioner to the Council in such manner or form and accompanied by such documents, particulars and fees as may be prescribed. (2) The Council may issue to the applicant a certificate to practise telemedicine for a period not exceeding three years subject to such terms and conditions as the Council may specify in such certificate. (3) The Council may at any time vary the terms and conditions of a certificate to practise telemedicine issued under subsection (2). (4) The Council may at any time cancel any certificate to practise telemedicine issued under subsection (2) if the person to whom the certificate is issued contravenes any term or condition specified in the certificate. (5) Any person who is aggrieved by the refusal of the Council to issue a certificate to practise telemedicine or by the cancellation of a certificate to practise telemedicine may appeal to the Minister whose decision shall be final.

Perakuan untuk mengamalkan teleperubatan

(1) Sesuatu permohonan untuk mendapatkan perakuan untuk mengamalkan teleperubatan yang disebut dalam perenggan 3(1)(b) hendaklah dibuat oleh seseorang pengamal perubatan yang didaftarkan atau dilesenkan di luar Malaysia melalui seorang pengamal perubatan Undang-Undang Malaysia AKTA 564 berdaftar penuh kepada Majlis mengikut cara atau dalam borang dan disertakan dengan apa-apa dokumen, butir dan fi yang ditetapkan. (2) Majlis boleh mengeluarkan suatu perakuan untuk mengamalkan teleperubatan kepada pemohon bagi suatu tempoh yang tidak melebihi tiga tahun tertakluk kepada apa-apa terma dan syarat yang ditentukan oleh Majlis dalam perakuan itu. (3) Majlis boleh pada bila-bila masa mengubah terma dan syarat sesuatu perakuan untuk mengamalkan teleperubatan yang dikeluarkan di bawah subseksyen (2). (4) Majlis boleh pada bila-bila masa membatalkan apa-apa perakuan untuk mengamalkan teleperubatan yang dikeluarkan di bawah subseksyen (2) jika orang yang kepadanya perakuan itu dikeluarkan melanggar mana-mana terma atau syarat yang dinyatakan dalam perakuan itu. (5) Mana-mana orang yang terkilan dengan keengganan Majlis untuk mengeluarkan suatu perakuan untuk mengamalkan teleperubatan atau dengan pembatalan sesuatu perakuan untuk mengamalkan teleperubatan boleh merayu kepada Menteri dan keputusan Menteri adalah muktamad.
