s 161 Hiwalah

(1) In this section, “property” includes a debt due by the muhal ‘alaih to the judgment debtor. (2) The following provisions shall apply where the execution is ordered by attachment of property in the possession or control of a muhal ‘alaih: (a) the bailiff shall serve on the muhal ‘alaih a hiwalah notice in Form MS 37, and the notice in Form MS 38 shall be used if the property is in the Court; (b) all property specified in a hiwalah notice shall be attached as from the service of the notice on the muhal ‘alaih to the extent or value therein mentioned, and any alienation or disposal of the property contrary to the terms of the notice, except with the leave of the Court, shall be void against the bailiff, and such action shall also be a contempt of Court; (c) the muhal ‘alaih may pay to the bailiff the amount claimed or may deliver to him the property attached; (d) if the muhal ‘alaih does not make such payment or delivery, the bailiff may serve on him a hiwalah summons in Form MS 39 and the Court shall examine him as to the property attached: Provided that— (i) no such summons shall be issued to a public servant in respect of money or property in his possession in his capacity as such, except with the leave of the Court and the consent in writing from the Treasury; and (ii) no such summons shall be issued in the case of money, investment funds or property in any Court; (e) the Court may hear other evidence on any hiwalah summons; (f) after hearing the summons, the Court may make an order for payment or delivery and may order execution to be issued against the muhal ‘alaih for any property found to have been lawfully attached in his hands, as if he were himself a judgment debtor for the amount claimed against the original judgment debtor, or for the amount or value of the property in the muhal ‘alaih’s hands, whichever is less; (g) the Court— (i) may order costs against the muhal ‘alaih, and may grant or refuse him his recourse therefor against the judgment debtor; (ii) may allow costs to the muhal ‘alaih against the judgment creditor, and may grant or refuse leave to treat the costs as costs of the execution; (h) if a debt due on a judgment and payable by instalments is attached, the muhal ‘alaih shall not be liable to pay except in accordance with the order for instalments; (i) payment by the muhal ‘alaih under this section shall be a valid discharge against the judgment debtor; (j) the bailiff may, at the request of the judgment creditor, and shall, if so ordered by the Court, withdraw any hiwalah notice or hiwalah summons; (k) a hiwalah notice shall be deemed to be vacated three months after service, unless proceedings under the summons are then pending or the Court otherwise orders.

Hiwalah

(1) Dalam seksyen ini, “harta” termasuklah suatu hutang yang kena dibayar oleh muhal ‘alaih kepada penghutang penghakiman. (2) Peruntukan yang berikut hendaklah terpakai jika pelaksanaan diperintahkan melalui penahanan harta dalam milikan atau kawalan seseorang muhal ‘alaih: (a) bailif hendaklah menyampaikan kepada muhal ‘alaih suatu notis hiwalah dalam Borang MS 37, dan notis dalam Borang MS 38 hendaklah digunakan jika harta itu berada di dalam Mahkamah; (b) segala harta yang dinyatakan dalam notis hiwalah hendaklah ditahan dari masa penyampaian notis itu kepada muhal ‘alaih setakat atau pada nilai yang disebut dalam notis itu, dan apa-apa pemberimilikan atau pelupusan harta itu yang bertentangan dengan terma-terma notis itu, kecuali dengan kebenaran Mahkamah, adalah tak sah terhadap bailif, dan perbuatan itu juga suatu penghinaan mahkamah; (c) muhal ‘alaih boleh membayar kepada bailif amaun yang dituntut atau boleh menghantarserahkan kepadanya harta yang ditahan itu; (d) jika muhal ‘alaih tidak membuat pembayaran atau penghantarserahan itu, bailif boleh menyampaikan kepadanya suatu saman hiwalah dalam Borang MS 39 dan Mahkamah hendaklah memeriksanya tentang harta yang ditahan itu: Dengan syarat bahawa— (i) tiada saman yang sedemikian boleh dikeluarkan kepada seseorang pekhidmat awam berkenaan dengan wang atau harta dalam milikannya atas sifatnya yang sedemikian, melainkan dengan kebenaran Mahkamah dan dengan kebenaran bertulis Perbendaharaan; dan (ii) tiada saman yang sedemikian boleh dikeluarkan dalam hal wang, kumpulan wang pelaburan atau harta di dalam mana-mana Mahkamah; (e) Mahkamah boleh mendengar keterangan lain mengenai mana-mana saman hiwalah; (f) selepas mendengar saman itu, Mahkamah boleh membuat suatu perintah pembayaran atau penghantarserahan dan boleh memerintahkan pelaksanaan dikeluarkan terhadap muhal 'alaih mengenai apa-apa harta dalam tangannya yang didapati telah ditahan dengan sah, seolah-olah muhal ‘alaih itu sendiri ialah penghutang penghakiman bagi amaun yang dituntut terhadap penghutang penghakiman yang asal, atau bagi amaun atau nilai harta dalam tangan muhal ‘alaih itu, mengikut mana-mana yang kurang; (g) Mahkamah— (i) boleh memerintahkan kos terhadap muhal ‘alaih, dan boleh membenarkan atau tidak membenarkan muhal ‘alaih itu menuntut kos itu daripada penghutang penghakiman; (ii) boleh membenarkan kos kepada muhal ‘alaih terhadap pemiutang penghakiman, dan boleh memberikan atau tidak memberikan kebenaran untuk menjadikan kos itu sebagai kos pelaksanaan; (h) jika hutang yang kena dibayar secara ansuran menurut suatu penghakiman ditahan, muhal ‘alaih tidaklah bertanggungan membuat pembayaran kecuali mengikut perintah ansuran itu; (i) pembayaran oleh muhal ‘alaih di bawah seksyen ini hendaklah menjadi suatu pelepasan yang sah terhadap penghutang penghakiman; (j) bailif boleh, atas permintaan pemiutang penghakiman dan hendaklah, jika diperintahkan sedemikian oleh Mahkamah, menarik balik mana-mana notis hiwalah atau saman hiwalah; (k) suatu notis hiwalah hendaklah disifatkan telah terbatal tiga bulan selepas penyampaian, melainkan jika prosiding di bawah saman itu masih belum selesai atau Mahkamah memerintahkan selainnya.
