s 31 Application to sue or defend as a poor person
(1) Any person who desires to commence or defend any action or other proceedings in his own right, and is unable to pay the Court fees therefor, may apply to the Court for leave to sue or defend as a poor person.
(2) An application under subsection (1) shall be made in Form MS 4 and supported by an affidavit containing the following particulars:
(a) his name, place of abode and occupation;
(b) a declaration that he is unable to pay the Court fees in the proceedings; and
(c) all the material facts of the case.
(3) The affidavit shall be prepared by the applicant or by an officer of the appropriate Court and shall be verified in the presence of a Judge or Registrar.
(4) Where the Court is satisfied—
(a) that the applicant is unable to pay the Court fees in the proceedings; and
(b) that the applicant has a good cause of action or defence, as the case may be,
the Court shall make an order admitting the applicant (hereinafter called the “poor person”) to sue or defend, as the case may be, as a poor person.
(5) Where an order is made under subsection (4), the summons and other process in the action or other proceedings and the relevant entry in the cause book shall be marked “orang miskin”.
(6) Where the Court is not so satisfied it shall dismiss the application and there shall be no appeal against the dismissal.

Permohonan untuk mendakwa atau membela sebagai orang miskin
(1) Mana-mana orang yang berhasrat untuk memulakan atau membela apa-apa tindakan atau prosiding lain mengikut haknya sendiri, dan tidak berupaya membayar fi Mahkamah baginya, boleh memohon kepada Mahkamah untuk mendapatkan kebenaran untuk mendakwa atau membela sebagai orang miskin.
(2) Permohonan di bawah subseksyen (1) hendaklah dibuat dalam Borang MS 4 dan disokong dengan afidavit yang mengandungi butir-butir yang berikut:
(a) nama, tempat tinggal dan pekerjaannya;
(b) akuan bahawa dia tidak berupaya membayar fi Mahkamah dalam prosiding itu; dan
(c) segala fakta matan kes itu.
(3) Afidavit itu hendaklah disediakan oleh pemohon atau oleh seorang pegawai Mahkamah yang berkenaan dan hendaklah ditentusahkan di hadapan seorang Hakim atau Pendaftar.
(4) Jika Mahkamah berpuas hati—
(a) bahawa pemohon tidak berupaya membayar fi Mahkamah dalam prosiding itu; dan
(b) bahawa pemohon mempunyai kausa tindakan atau pembelaan yang baik, mengikut mana-mana yang berkenaan,
maka Mahkamah hendaklah membuat suatu perintah membenarkan pemohon (kemudian daripada ini disebut "orang miskin") untuk mendakwa atau membela, mengikut mana-mana yang berkenaan, sebagai seorang orang miskin.
(5) Jika suatu perintah dibuat di bawah subseksyen (4), saman atau proses lain dalam tindakan atau prosiding lain itu dan catatan yang relevan dalam buku kausa hendaklah ditanda “orang miskin”.
(6) Jika Mahkamah tidak berpuas hati sedemikian Mahkamah hendaklah menolak permohonan itu dan tiada rayuan boleh dibuat terhadap penolakan itu.
