Syariah Court Civil Procedure (Federal Territories) Act 1998 s 52
s 52 When allowed
(1) The Court may order service of a summons or an application out of the jurisdiction—
(a) if the whole subject matter of the action relates to immovable property situated within the Federal Territories;
(b) if any relief is sought against any person domiciled or ordinarily residing or carrying on business within the Federal Territories;
(c) if, the action being properly brought against a person duly served within the Federal Territories, a person out of the Federal Territories is a necessary or proper party thereto; or
(d) if in any case arising from marriage, the residence of one of the parties to the marriage is at the time of the application within the Federal Territories.
(2) Subject to section 54, any order giving leave to effect service out of the jurisdiction outside Malaysia shall direct in what mode the service is to be effected and how such service may be proved.

Bila dibenarkan
(1) Mahkamah boleh memerintahkan penyampaian sesuatu saman atau permohonan di luar bidang kuasa—
(a) jika keseluruhan hal perkara tindakan itu berhubungan dengan harta tak alih yang terletak di Wilayah-Wilayah Persekutuan;
(b) jika apa-apa relief diminta terhadap mana-mana orang yang berdomisil atau biasanya bermastautin atau menjalankan perniagaan di Wilayah-Wilayah Persekutuan;
(c) jika tindakan itu dibawa dengan sepatutnya terhadap seseorang yang kepadanya penyampaian dibuat dengan sempurna di Wilayah-Wilayah Persekutuan, seseorang di
luar bidang kuasa ialah suatu pihak yang perlu atau patut dalam tindakan itu; atau
(d) jika dalam apa-apa hal yang berbangkit daripada perkahwinan, kemastautinan salah satu pihak kepada perkahwinan itu pada masa permohonan itu ialah di Wilayah-Wilayah Persekutuan.
(2) Tertakluk pada seksyen 54, apa-apa perintah yang memberikan kebenaran untuk melaksanakan penyampaian di luar bidang kuasa hendaklah mengarahkan cara penyampaian itu hendakdilaksanakan dan bagaimana penyampaian itu boleh dibuktikan.
