Syariah Court Civil Procedure (Federal Territories) Act 1998 s 95
(1) The plaintiff may, with leave of the Court, at any time before judgment withdraw any proceedings wholly or in part by giving notice in Form MS 19 to the Court and serving a copy of the notice to the defendant. (2) Where the plaintiff withdraws any proceedings under subsection (1), the defendant shall be entitled to the costs of the proceedings.
Penarikan balik tuntutan
(1) Plaintif boleh, dengan kebenaran Mahkamah, pada bila-bila masa sebelum penghakiman, menarik balik mana-mana prosiding keseluruhannya atau sebahagiannya dengan memberikan notis dalam Borang MS 19 kepada Mahkamah dan menyampaikan suatu salinan notis itu kepada defendan. (2) Jika plaintif menarik balik mana-mana prosiding di bawah subseksyen (1), defendan berhak mendapat kos prosiding itu.
