s 32 Implied guarantee as to acceptable quality

(1) Where goods are supplied to a consumer there shall be implied a guarantee that the goods are of acceptable quality. (2) For the purposes of subsection (1), goods shall be deemed to be of acceptable quality— (a) if they are— (i) fit for all the purposes for which goods of the type in question are commonly supplied; (ii) acceptable in appearance and finish; (iii) free from minor defects; (iv) safe; and (v) durable; and (b) a reasonable consumer fully acquainted with the state and condition of the goods, including any hidden defects, would regard the goods as acceptable having regard to— (i) the nature of the goods; (ii) the price; (iii) any statements made about the goods on any packaging or label on the goods; (iv) any representation made about the goods by the supplier or the manufacturer; and (v) all other relevant circumstances of the supply of the goods. (3) Where any defects in the goods have been specifically drawn to the consumer’s attention before he agrees to the supply, then, the goods shall not be deemed to have failed to comply with the implied guarantee as to acceptable quality by reason only of those defects. (4) Where goods are displayed for sale or hire, the defects that are to be treated as having been specifically drawn to the consumer’s attention for the purposes of subsection (3) shall be defects disclosed on a written notice displayed with the goods. (5) Goods shall not be deemed to have failed to comply with the implied guarantee as to acceptable quality if— (a) the goods have been used in a manner or to an extent which is inconsistent with the manner or extent of use that a reasonable consumer would expect to obtain from the goods; and (b) the goods would have complied with the implied guarantee as to acceptable quality if they had not been used in that manner or to that extent. (6) A reference in subsections (3) and (4) to a defect is a reference to any failure of the goods to comply with the implied guarantee as to acceptable quality.

Gerenti tersirat mengenai kualiti boleh terima

(1) Jika barang dibekalkan kepada pengguna, maka hendaklah tersirat suatu gerenti bahawa barang itu adalah daripada kualiti boleh terima. (2) Bagi maksud subseksyen (1), barang itu adalah disifatkan daripada kualiti boleh terima— (a) jika barang itu— (i) sesuai bagi semua maksud yang baginya barang daripada jenis yang berkenaan itu lazimnya dibekalkan; (ii) dapat diterima dari segi rupa dan kemasan; (iii) bebas daripada kecacatan yang kecil; (iv) selamat; dan (v) tahan lama; dan (b) seseorang pengguna yang munasabah yang tahu sepenuhnya tentang sifat dan keadaan barang itu, termasuk apa-apa kecacatan yang tersembunyi, akan menganggap barang itu sebagai dapat diterima dengan mengambil kira— (i) jenis barang; (ii) harga; (iii) apa-apa pernyataan yang dibuat mengenai barang itu pada apa-apa pembungkus atau label pada barang itu; (iv) apa-apa representasi yang dibuat mengenai barang itu oleh pembekal atau pengilang; dan (v) semua hal keadaan lain yang berkaitan dengan pembekalan barang itu. (3) Jika apa-apa kecacatan pada barang itu telah dibawa secara khusus kepada pengetahuan pengguna sebelum dia bersetuju dengan pembekalan itu, maka barang itu tidaklah disifatkan gagal untuk mematuhi gerenti tersirat mengenai kualiti boleh terima hanya oleh sebab kecacatan itu. (4) Jika barang dipamerkan untuk jualan atau sewaan, kecacatan yang dianggap telah dibawa secara khusus kepada pengetahuan pengguna bagi maksud subseksyen (3) ialah kecacatan yang didedahkan dalam suatu notis bertulis yang dipamerkan bersama barang itu. (5) Barang tidaklah disifatkan telah gagal untuk mematuhi gerenti tersirat mengenai kualiti boleh terima jika— (a) barang itu telah digunakan dengan cara atau sehingga takat yang tidak selaras dengan cara atau takat kegunaan yang dijangkakan oleh seseorang pengguna munasabah akan didapati olehnya daripada barang itu; dan (b) barang itu akan mematuhi gerenti tersirat mengenai kualiti boleh terima jika barang itu tidak digunakan dengan cara atau sehingga takat itu. (6) Sebutan dalam subseksyen (3) dan (4) tentang sesuatu kecacatan ialah sebutan tentang apa-apa kegagalan barang itu untuk mematuhi gerenti tersirat mengenai kualiti boleh terima.
