s 45 Manner of rejecting goods

(1) The consumer shall exercise the right conferred under this Act to reject goods by notifying the supplier of the decision to reject the goods and of the ground or grounds for the rejection. (2) Where the consumer exercises the right to reject goods, the consumer shall return the rejected goods to the supplier unless— (a) because of— (i) the nature of the failure to comply with the guarantee in respect of which the consumer has the right to reject the goods; or (ii) the size or height or method of attachment, the goods cannot be returned or removed or transported without significant cost to the consumer, in which case the supplier shall collect the goods at its own expense; (b) because of the method of attachment, the goods cannot be returned or removed without significant damage to the real or personal property to which they are attached, in which case the supplier shall compensate the consumer for any loss or damage resulting from or consequent upon such removal; or (c) the goods have already been returned to, or retrieved by, the supplier. (3) Where the ownership in the goods has passed to the consumer before the consumer exercises the right of rejection, the ownership in the goods re-vests in the supplier upon notification of rejection.

Cara menolak barang

(1) Pengguna hendaklah menggunakan hak yang diberikan di bawah Akta ini untuk menolak barang dengan cara memberitahu pembekal tentang keputusan untuk menolak barang itu dan tentang alasan atau alasan-alasan bagi penolakan itu. (2) Jika pengguna menggunakan hak untuk menolak barang, pengguna hendaklah memulangkan barang yang ditolak itu kepada pembekal melainkan jika— (a) oleh sebab— (i) sifat kegagalan untuk mematuhi gerenti yang berkenaan dengannya pengguna mempunyai hak untuk menolak barang itu; atau (ii) saiz atau ketinggian atau cara pemasangannya, barang itu tidak dapat dipulangkan atau dipindahkan atau diangkut tanpa kos yang banyak kepada pengguna, dan dalam hal itu pembekal hendaklah mengambil barang itu dengan perbelanjaannya sendiri; (b) oleh sebab cara pemasangannya barang itu tidak dapat dipulangkan atau dipindahkan tanpa kerosakan yang banyak kepada harta tak alih atau harta alih yang kepadanya barang itu dipasangkan, dan dalam hal itu pembekal hendaklah mengganti rugi pengguna bagi apaapa kerugian atau kerosakan akibat atau hasil daripada pemindahan itu; atau (c) barang itu sudah pun dipulangkan kepada, atau diambil semula oleh, pembekal. (3) Jika pemunyaan barang itu telah berpindah kepada pengguna sebelum pengguna menggunakan hak penolakan, pemunyaan dalam barang itu terletak hak semula pada pembekal dengan pemberitahuan penolakan itu.
