Order for disposal 16. (1) A right holder of a protected layout-design or a person ordered to deliver up an integrated circuit or article under section 15 may apply to the High Court for— (a) an order for disposal; or (b) a decision that no order for disposal be made. (2) An order for disposal may order that the integrated circuit or article delivered up under section 15— (a) be forfeited to the right holder; or (b) be destroyed or disposed of as the High Court may specify. (3) In deciding what order or decision to make under subsection (1), the High Court shall have regard to whether the other remedies available to the applicant would be adequate to compensate the applicant and protect the interests of the applicant. (4) The High Court shall issue directions as to the service of a notice of the application under this section on persons having an interest in the integrated circuit or article delivered up under section 15. (5) Any person having an interest in the integrated circuit or article delivered up under section 15 shall be entitled to— (a) appear in the proceedings under this section, whether or not the person is served with a notice; and (b) appeal against any order made, whether or not that person appears in the proceedings under this section. (6) An order made under this section shall not take effect until the end of the period within which notice of an appeal may be given or, if before the end of that period notice of appeal is duly given, until the final determination or abandonment of the proceedings on the appeal. (7) If there is more than one person interested in the integrated circuit or article delivered up under section 15, the High Court may direct that the integrated circuit or article be sold or dealt with in any other manner and the proceeds divided and shall make any other order as it considers fit. (8) If the High Court decides that no order should be made under this section, the person in whose possession, custody or control the integrated circuit or article was before being delivered up under section 15 shall be entitled to its return and the High Court may, on the application of that person or any person aggrieved by an order to deliver up made under section 15, make an order awarding compensation for any damage sustained by virtue of the delivery up. (9) Nothing in this section shall render an advocate and solicitor liable to pay compensation for any damage sustained in respect of an act done by him in his professional capacity on behalf of a client.

Perintah bagi pelupusan

(1) Seseorang pemegang hak sesuatu reka bentuk susun atur terlindung atau seseorang yang diperintahkan supaya menyerahkan litar bersepadu atau barang di bawah seksyen 15 boleh memohon kepada Mahkamah Tinggi untuk mendapatkan— (a) perintah bagi pelupusan; atau (b) keputusan bahawa tiada perintah bagi pelupusan dibuat. (2) Sesuatu perintah bagi pelupusan boleh memerintahkan bahawa litar bersepadu atau barang yang diserahkan di bawah seksyen 15— (a) adalah terlucut hak kepada pemegang hak; atau (b) hendaklah dimusnahkan atau dilupuskan sebagaimana yang ditetapkan oleh Mahkamah Tinggi. (3) Dalam memutuskan perintah atau keputusan apa yang hendak dibuat di bawah subseksyen (1), Mahkamah Tinggi hendaklah mengambil kira sama ada remedi lain yang tersedia bagi pemohon mencukupi untuk memampasi pemohon dan melindungi kepentingan pemohon. (4) Mahkamah Tinggi hendaklah mengeluarkan arahan tentang penyampaian notis tentang permohonan di bawah seksyen ini kepada orang yang mempunyai kepentingan mengenai litar bersepadu atau barang yang diserahkan di bawah seksyen 15. (5) Mana-mana orang yang mempunyai kepentingan mengenai litar bersepadu atau barang yang diserahkan di bawah seksyen 15 berhak— (a) hadir dalam prosiding di bawah seksyen ini, sama ada atau tidak notis disampaikan kepada orang itu; dan (b) merayu terhadap mana-mana perintah yang dibuat, sama ada atau tidak orang itu hadir dalam prosiding di bawah seksyen ini. (6) Sesuatu perintah yang dibuat di bawah seksyen ini tidak boleh mula berkuat kuasa sehingga akhir tempoh notis rayuan boleh diberikan atau, jika sebelum akhir tempoh itu notis rayuan telah diberikan dengan sewajarnya, sehingga penentuan muktamad atau peninggalan prosiding atas rayuan itu. (7) Jika terdapat lebih daripada satu orang yang mempunyai kepentingan mengenai litar bersepadu atau barang yang diserahkan di bawah seksyen 15, Mahkamah Tinggi boleh mengarahkan supaya litar bersepadu atau barang itu dijual atau diuruskan mengikut apa-apa cara lain dan hasilnya dibahagikan dan hendaklah membuat apa-apa perintah lain yang didapatinya patut. (8) Jika Mahkamah Tinggi memutuskan bahawa tiada perintah patut dıbuat di bawah seksyen inl, orang yang dalam mılk, Jagaan atau kawalannya litar bersepadu atau barang itu berada sebelum diserahkan di bawah seksyen 15 hendaklah berhak mendapatkannya balik dan Mahkamah Tinggi boleh, atas permohonan orang itu atau mana-mana orang yang terkilan dengan perintah bagi penyerahan yang dibuat di bawah seksyen 15, membuat perintah mengawardkan pampasan bagi apa-apa kerugian yang dialami oleh sebab penyerahan itu. (9) Tiada apa-apa jua dalam seksyen ini boleh menyebabkan seseorang peguambela dan peguamcara bertanggungan untuk membayar pampasan bagi apa-apa kerugian yang dialami berkenaan dengan perbuatan yang dilakukan olehnya dalam tugas ikhtisasnya bagi pihak seseorang klien.
