s 28 Compulsory licence

(1) A person who claims that he requires a licence to do any act referred to in section 9 in relation to a protected layout-design may apply to the High Court for the grant of a compulsory licence on any of the following grounds: (a) that there is no production of the protected layout-design, any integrated circuit incorporating the protected layoutdesign or any article containing such an integrated circuit in Malaysia without any legitimate reason; (b) that there is no production of the protected layout-design, any integrated circuit incorporating the protected layoutdesign or any article containing such an integrated circuit for sale in Malaysia; or (c) that there is production of the protected layout-design, integrated circuits incorporating the protected layout-design or articles containing such integrated circuits in Malaysia but the protected layout-design, integrated circuit incorporating the protected layout-design or the article containing such an integrated circuit produced is sold at unreasonably high prices or does not meet the public demand without any legitimate reason. (2) An application to the High Court under subsection (1) shall only be made after the applicant for the compulsory licence has made efforts to obtain authorization from the right holder on reasonable commercial terms and conditions but such efforts have not been successful within a reasonable period of time. (3) If the High Court is satisfied that any of the grounds referred to in subsection (1) is established, the High Court may make an order for the grant of a compulsory licence in accordance with the application on such terms as the High Court considers fit. (4) The High Court shall specify in the order the remuneration to be paid to the right holder for the compulsory licence as the High Court considers reasonable. (5) For the purposes of subsection (4), the remuneration payable shall be an adequate remuneration in the circumstances of the case, taking into account the economic value of the compulsory licence granted under subsection (3).

(1) Seseorang yang menuntut bahawa orang itu memerlukan lesen untuk melakukan mana-mana perbuatan yang disebut dalam seksyen 9 berhubung dengan sesuatu reka bentuk susun atur terlindung boleh memohon kepada Mahkamah Tinggi supaya diberi suatu lesen wajib atas mana-mana alasan yang berikut: (a) bahawa tidak ada pengeluaran reka bentuk susun atur terlindung itu, apa-apa litar bersepadu yang dalamnya digabungkan reka bentuk susun atur terlindung itu atau apa-apa barang yang mengandungi litar bersepadu sedemikian di Malaysia tanpa apa-apa sebab yang sah; (b) bahawa tidak ada pengeluaran reka bentuk susun atur terlindung itu, apa-apa litar bersepadu yang dalamnya digabungkan reka bentuk susun atur terlindung itu atau apa-apa barang yang mengandungi litar bersepadu sedemikian untuk dijual di Malaysia; atau (c) bahawa ada pengeluaran reka bentuk susun atur terlindung itu, litar bersepadu yang dalamnya digabungkan reka bentuk susun atur terlindung itu atau barang yang mengandungi litar bersepadu sedemikian di Malaysia tetapi reka bentuk susun atur terlindung itu, litar bersepadu yang dalamnya digabungkan reka bentuk susun atur terlindung itu atau barang yang mengandungi litar bersepadu sedemıkıan yang dıkeluarkan dijual pada harga tinggı yang tıdak berpatutan atau tidak memenuhi permıntaan awam tanpa apa-apa sebab yang sah. (2) Sesuatu permohonan kepada Mahkamah Tinggi di bawah subseksyen (1) hanya boleh dibuat selepas pemohon lesen wajib itu telah berusaha untuk memperoleh pemberian kuasa daripada pemegang hak atas terma dan syarat perdagangan yang berpatutan tetapi usaha itu tidak berjaya dalam tempoh masa yang munasabah. (3) Jika Mahkamah Tinggi berpuas hati bahawa mana-mana alasan yang disebut dalam subseksyen (1) wujud, Mahkamah Tinggi boleh membuat perintah bagi pemberian lesen wajib mengikut permohonan itu atas apa-apa terma yang didapati patut oleh Mahkamah Tinggi. (4) Mahkamah Tinggi hendaklah menetapkan dalam perintah itu saraan yang hendaklah dibayar kepada pemegang hak bagi lesen wajib itu sebagaimana yang didapati munasabah oleh Mahkamah Tinggi. (5) Bagi maksud subseksyen (4), saraan yang kena dibayar hendaklah suatu saraan yang mencukupi mengikut hal keadaan kes, dengan mengambil kira nilai ekonomi lesen wajib yang diberikan di bawah subseksyen (3).
