s 110 Forfeiture of things, etc., seized

(1) Any object, material, book, document or other thing seized under this Act shall be liable to forfeiture. (2) Where anything has been seized under this Act the enforcement officer may at his discretion temporarily return such thing to the owner of the same on security being furnished to his satisfaction that such thing shall be surrendered to him on demand or to produce it before a court of competent jurisdiction. (3) An order for the forfeiture under subsection (1) shall be made if it is proved to the satisfaction of the court that an offence under this Act or any regulations made under this Act has been committed and that the object, material, book, document or other thing was the subject-matter of or was used in the commission of the offence, even though no person has been convicted of such offence. (4) If there is no prosecution with regard to any object, material, book, document or other thing seized under this Act, such object, material, book, document or other thing shall be taken and deemed to be forfeited at the expiration of a period of one calendar month from the date of service of a notice to the last known address of the person from whom the object, material, book, document or other thing was seized indicating that there is no prosecution in respect of such object, material, book, document or other thing, unless before the expiration of that period a claim thereto is made in the manner set out in subsections (5), (6), (7) and (8). (5) Any person asserting that he is the owner of the object, material, book, document or other thing referred to under subsection (4) and that it is not liable to forfeiture may personally or by his agent authorized in writing give written notice to the enforcement officer or police officer in whose possession such object, material, book, document or other thing is held that he claims the object, material, book, document or other thing. (6) On receipt of the notice referred to in subsection (5), the enforcement officer or the police officer shall refer the matter to the Magistrate for a decision. (7) The Magistrate to whom a matter is referred under subsection (6) shall issue a summons requiring the person asserting that he is the owner of the object, material, book, document or other thing and the person from whom it was seized to appear before the Magistrate, and when they appear or when they fail to appear, due service of the summons having been proved, the Magistrate shall proceed to examine the matter. (8) If it is proved that an offence under this Act or any regulations made under this Act has been committed and that object, material, book, document or other thing referred to in subsection (7) was the subject-matter of or was used in the commission of such offence, the Magistrate shall order the object, material, book, document or other thing to be forfeited and shall, in the absence of such proof, order its release. (9) Any object, material, book, document or other thing forfeited or deemed to be forfeited shall be delivered to an enforcement officer or a police officer and shall be disposed of in accordance with the directions of the Magistrate. (10) Where anything seized in exercise of the powers conferred under section 100 or section 101 is of a perishable nature or where the custody of such thing involves unreasonable expense and inconvenience, the Commissioner, Deputy Commissioner or Assistant Commissioner or the enforcement officer, as the case may be, may direct that such thing be sold at any time and the proceeds of the sale be held to abide by the result of any prosecution or claim under this section.

(1) Apa-apa objek, bahan, buku, dokumen atau benda lain yang disita di bawah Akta ini boleh dilucuthakkan. (2) Jika apa-apa benda telah disita di bawah Akta ini pegawai penguat kuasa boleh mengikut budi bicaranya memulangkan secara sementara apa-apa benda itu kepada pemunya atas jaminan yang diberikan yang memuaskan hatinya bahawa benda itu hendaklah diserahkan kepadanya atas permintaan atau untuk dikemukakan di hadapan mahkamah yang mempunyai bidang kuasa berwibawa. (3) Suatu perintah bagi pelucuthakan di bawah subseksyen (1) hendaklah dibuat jika dibuktikan sehingga mahkamah berpuas hati bahawa suatu kesalahan di bawah Akta ini atau mana-mana peraturan yang dibuat di bawah Akta ini telah dilakukan dan bahawa objek, bahan, buku, dokumen atau benda lain itu merupakan hal perkara bagi atau digunakan dalam pelakuan kesalahan itu, walaupun tiada orang telah disabitkan atas kesalahan itu. (4) Jika tidak ada pendakwaan berkenaan dengan apa-apa objek, bahan, buku, dokumen atau benda lain yang disita di bawah Akta ini, objek, bahan, buku, dokumen atau benda lain itu hendaklah diambil dan disifatkan terlucut hak apabila habis tempoh satu bulan kalendar dari tarikh penyampaian notis ke alamat yang terakhir diketahui orang yang daripadanya objek, bahan, buku, dokumen atau benda lain itu disita yang menyatakan bahawa tiada pendakwaan berkenaan dengan objek, bahan, buku, dokumen atau benda lain itu, melainkan jika sebelum habis tempoh itu suatu tuntutan baginya telah dibuat mengikut cara yang dinyatakan dalam subseksyen (5), (6), (7) dan (8). (5) Mana-mana orang yang menegaskan bahawa dia ialah pemunya objek, bahan, buku, dokumen atau benda lain yang disebut di bawah subseksyen (4) dan bahawa objek, bahan, buku, dokumen atau benda lain itu tidak boleh dilucuthakkan boleh memberikan sendiri atau melalui ejennya yang diberi kuasa secara bertulis notis bertulis kepada pegawai penguat kuasa atau pegawai polis yang dalam milikannya objek, bahan, buku, dokumen atau benda lain itu dipegang bahawa dia menuntut objek, bahan, buku, dokumen atau benda lain itu. (6) Apabila notis yang disebut dalam subseksyen (5) diterima, pegawai penguat kuasa atau pegawai polis itu hendaklah merujukkan perkara itu kepada Majistret untuk mendapatkan suatu keputusan. (7) Majistret yang kepadanya suatu perkara dirujukkan di bawah subseksyen (6) hendaklah mengeluarkan suatu saman yang menghendaki orang yang menegaskan bahawa dia ialah pemunya objek, bahan, buku, dokumen atau benda lain itu dan orang yang daripadanya objek, bahan, buku, dokumen atau benda lain itu disita hadir di hadapan Majistret itu, dan apabila mereka hadir atau apabila mereka tidak hadir, setelah dibuktikan bahawa saman itu telah disampaikan dengan sewajarnya, Majistret hendaklah meneruskan pemeriksaan perkara itu. (8) Jika dibuktikan bahawa suatu kesalahan di bawah Akta ini atau mana-mana peraturan yang dibuat di bawah Akta ini telah dilakukan dan bahawa objek, bahan, buku, dokumen atau benda lain yang disebut dalam subseksyen (7) merupakan hal perkara bagi atau telah digunakan dalam pelakuan kesalahan itu, maka Majistret hendaklah memerintahkan supaya objek, bahan, buku, dokumen atau benda lain itu dilucuthakkan dan hendaklah, jika tiada bukti sedemikian, memerintahkan supaya objek, bahan, buku, dokumen atau benda lain itu dilepaskan. (9) Mana-mana objek, bahan, buku, dokumen atau benda lain yang dilucuthakkan atau disifatkan terlucut hak hendaklah dihantarserahkan kepada pegawai penguat kuasa atau pegawai polis dan hendaklah dilupuskan mengikut arahan Majistret. (10) Jika apa-apa jua yang disita pada menjalankan kuasa yang diberikan di bawah seksyen 100 atau seksyen 101 merupakan daripada jenis yang mudah musnah atau jika jagaan benda itu melibatkan perbelanjaan dan kesusahan yang tidak munasabah, Pesuruhjaya, Timbalan Pesuruhjaya atau Penolong Pesuruhjaya atau pegawai penguat kuasa, mengikut mana-mana yang berkenaan, boleh mengarahkan supaya benda itu dijual pada bila-bila masa dan hasil jualan itu dipegang untuk mematuhi keputusan apa-apa pendakwaan atau tuntutan di bawah seksyen ini.
