s 16 Failure or impossibility to act
(1) Where an arbitrator becomes in law or in fact unable to perform the functions of that office, or for other reasons fails to act without undue delay, that arbitrator’s mandate terminates on withdrawal from office or if the parties agree on the termination.
(2) Where any party disagrees on the termination of the mandate of the arbitrator, any party may apply to the High Court to decide on such termination and no appeal shall lie against the decision of the High Court.
(3) Where, under this section or subsection 15(2), an arbitrator withdraws from office or a party agrees to the termination of the mandate of an arbitrator, it shall not imply acceptance of the validity of any ground referred to in this section or subsection 14(3).

Kegagalan atau kemustahilan untuk bertindak
(1) Jika seseorang penimbang tara menjadi tidak berupaya dari segi undang-undang atau hakikat untuk melaksanakan fungsi jawatan itu, atau bagi sebab lain gagal bertindak tanpa kelengahan yang tidak wajar, mandat penimbang tara itu tamat dengan penarikan diri daripada jawatan atau jika pihak-pihak bersetuju dengan penamatan itu.
(2) Jika mana-mana pihak tidak bersetuju dengan penamatan mandat penimbang tara itu, mana-mana pihak boleh memohon kepada Mahkamah Tinggi untuk memutuskan penamatan sedemikian dan tiada rayuan boleh dibuat terhadap keputusan Mahkamah Tinggi itu.
(3) Jika, di bawah seksyen ini atau subseksyen 15(2), seorang penimbang tara menarik diri daripada jawatan atau suatu pihak bersetuju dengan penamatan mandat seseorang penimbang tara, maka tidaklah boleh tersirat penerimaan tentang kesahan apa-apa alasan yang disebut dalam seksyen ini atau subseksyen 14(3).
