s 27 Default of a party

Unless otherwise agreed by the parties, if without showing sufficient cause— (a) the claimant fails to communicate the statement of claim in accordance with subsection 25(1), the arbitral tribunal shall terminate the proceedings; (b) the respondent fails to communicate the statement of defence in accordance with subsection 25(1), the arbitral tribunal shall continue the proceedings without treating such failure in itself as an admission of the claimant’s allegations; (c) any party fails to appear at a hearing or to produce documentary evidence, the arbitral tribunal may continue the proceedings and make the award on the evidence before it; or (d) the claimant fails to proceed with the claim, the arbitral tribunal may make an award dismissing the claim or give directions, with or without conditions, for the speedy determination of the claim.

Keingkaran suatu pihak

Melainkan jika dipersetujui selainnya oleh pihak-pihak, jika tanpa menunjukkan sebab yang mencukupi— (a) pihak menuntut gagal menyampaikan pernyataan tuntutan mengikut subseksyen 25(1), tribunal timbang tara hendaklah menamatkan prosiding itu; (b) responden gagal menyampaikan pernyataan pembelaan mengikut subseksyen 25(1), tribunal timbang tara hendaklah meneruskan prosiding itu tanpa menganggap kegagalan itu dengan sendirinya sebagai suatu pengakuan kepada pengataan pihak menuntut; (c) mana-mana pihak gagal hadir di suatu pendengaran atau mengemukakan keterangan dokumentar, tribunal timbang tara boleh meneruskan prosiding itu dan membuat award berdasarkan keterangan di hadapannya; atau (d) pihak menuntut gagal meneruskan tuntutan, tribunal timbang tara boleh membuat suatu award yang menolak tuntutan atau memberikan arahan, dengan atau tanpa syarat, bagi menentukan tuntutan itu dengan cepat.
