s 56 Special powers during emergency

(1) The Minister shall have any or all of the following powers during an emergency: (a) to prohibit or restrict the use of water— (i) generally or for specified purposes; (ii) during specified hours of the day or otherwise; or (iii) in a specified manner; (b) to impose— (i) limits on the quantities of water which may be consumed over any specified period; (ii) any surcharge in respect of the consumption of water in excess of any limit imposed; or (iii) any other conditions as the Minister may think necessary; (c) to order a licensee or any person owning or operating a water supply system to cease operations on such terms and for such time as the Minister thinks necessary; or (d) to order any person to supply water on such terms and conditions as the Minister thinks necessary. (2) The Minister shall, as soon as practicable, after exercising any or all of his powers specified under subsection (1), publish in the Gazette a notice specifying the particulars of the power exercised and action taken under subsection (1). (3) The Minister may on such grounds as he thinks fit— (a) limit the application of subsection (1) to specified areas, groups, class of persons, premises or activities; and (b) suspend or waive any provisions of this section. (4) The Minister may direct the Commission to— (a) take temporary possession of any water supply system of a licensee and operate it or direct any other person to operate it in such manner as the Minister thinks fit; and (b) take or cause to be taken such measures including the installation of restrictive, controlling and measuring devices and the regulation and control of the disposition of appliances as may be necessary to ensure compliance with this section, and the licensee having control or possession of the water supply system shall hand over the control or possession of the water supply system to any officer authorized by the Commission for that purpose or any other person as the Minister thinks fit and the licensee shall take all such measures and provide all such assistance as may be required by the Commission, officer or person. (5) A decision, order or direction of the Minister in the exercise of his powers under this section shall be final and shall not be challenged, appealed against, reviewed, quashed or questioned in any court. (6) A person who fails to comply with the order of the Minister or the prohibition, restriction or imposition made by the Minister under subsection (1) or the requirement under subsection (4) commits an offence and shall, on conviction, be liable to a fine not exceeding three hundred thousand ringgit or to imprisonment for a term not exceeding three years or to both. (7) Where any premises is occupied by any person other than the owner, the occupier of the premises shall be presumed to have committed the offence under this section unless it is proved that he has taken all reasonable steps to prevent such commission. (8) The Federal Government, the Commission and their employees and agents shall not be liable for any action for breach of contract or for any loss or damage occasioned by any disconnection, stoppage, reduction or restriction of water supply under this section. (9) Every licensee and their employees and agents shall not be liable for any action for breach of contract or for any loss or damage occasioned by any disconnection, stoppage, reduction or restriction of the supply of water under this section except where the disconnection, stoppage, reduction or restriction of the supply of water was caused by— (a) the negligence or wilful act of the licensee, their employees or agents; or (b) a breach by the licensee of the terms and conditions of its licence or the provisions of this Act or its subsidiary legislation. (10) A person referred to in paragraphs (1)(c) and (d) shall not be liable for any action for breach of contract or for any loss or damage occasioned by any cessation of operations or the supply of water, as the case may be, under this section. (11) For the purposes of this section, an “emergency” means a circumstance where— (a) water supply is insufficient due to excessive drought or industrial unrest, strike or lock-out; (b) the supply of water or water supply system endangers or poses a threat to public safety or public health; or (c) an event occurs which gives rise to a dire situation which the Minister considers it necessary to exercise his powers under this section.

Kuasa khas semasa kecemasan

(1) Menteri hendaklah mempunyai mana-mana atau semua kuasa yang berikut semasa suatu kecemasan: (a) melarang atau menyekat penggunaan air— (i) secara amnya atau bagi maksud yang dinyatakan; (ii) semasa waktu-waktu yang dinyatakan atau selainnya; atau (iii) mengikut cara yang dinyatakan; (b) mengenakan— (i) had ke atas jumlah air yang boleh digunakan bagi apa-apa tempoh yang dinyatakan; (ii) apa-apa surcaj berkenaan dengan penggunaan air yang melebihi had yang dikenakan; atau (iii) apa-apa syarat lain yang difikirkan perlu oleh Menteri; (c) memerintahkan pemegang lesen atau mana-mana orang yang memiliki atau mengendalikan suatu sistem bekalan air untuk menghentikan pengendaliannya atas apa-apa terma dan selama apa-apa tempoh yang difikirkan perlu oleh Menteri; atau (d) memerintahkan mana-mana orang untuk membekalkan air atas apa-apa terma dan syarat yang difikirkan perlu oleh Menteri. (2) Menteri hendaklah, dengan secepat yang dapat dilaksanakan, selepas menjalankan mana-mana atau semua kuasanya yang dinyatakan di bawah subseksyen (1), menyiarkan suatu notis dalam Warta yang menyatakan butir-butir mengenai kuasa yang telah dijalankan dan tindakan yang telah diambil di bawah subseksyen (1). (3) Menteri boleh atas apa-apa alasan yang difikirkannya patut— (a) mengehadkan pemakaian subseksyen (1) bagi kawasan, kumpulan, golongan orang, premis atau aktiviti yang dinyatakan; dan (b) menggantungkan atau mengetepikan mana-mana peruntukan seksyen ini. (4) Menteri boleh mengarahkan Suruhanjaya supaya— (a) mengambil milikan sementara ke atas mana-mana sistem bekalan air pemegang lesen dan mengendalikannya atau mengarahkan mana-mana orang lain untuk mengendalikannya mengikut apa-apa cara difikirkan patut oleh Menteri; dan (b) mengambil atau menyebabkan supaya diambil apa-apa langkah termasuk pemasangan peranti penyekatan, pengawalan dan penyukatan serta pengawalseliaan dan pengawalan pelupusan perkakas yang perlu bagi memastikan pematuhan seksyen ini, dan pemegang lesen yang mempunyai kawalan atau milikan ke atas sistem bekalan air itu hendaklah menyerahkan kawalan atau milikan ke atas sistem bekalan air itu kepada mana-mana pegawai yang diberi kuasa oleh Suruhanjaya bagi maksud itu atau manamana orang lain yang difikirkan patut oleh Menteri serta pemegang lesen itu hendaklah mengambil segala langkah dan memberikan segala bantuan yang dikehendaki oleh Suruhanjaya, pegawai atau orang itu. (5) Sesuatu keputusan, perintah atau arahan Menteri dalam menjalankan kuasanya di bawah seksyen ini adalah muktamad dan tidak boleh dicabar, dirayukan, dikaji semula, dibatalkan atau dipersoalkan dalam mana-mana mahkamah. (6) Seseorang yang tidak mematuhi perintah Menteri atau larangan, sekatan atau pengenaan kuasa yang dibuat di bawah subseksyen (1) atau kehendak di bawah subseksyen (4) melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi tiga ratus ribu ringgit atau dipenjarakan selama tempoh tidak melebihi tiga tahun atau kedua-duanya. (7) Jika mana-mana premis dihuni oleh mana-mana orang selain pemiliknya, penghuni premis itu hendaklah dianggap telah melakukan kesalahan di bawah seksyen ini melainkan jika dibuktikan bahawa dia telah mengambil semua langkah yang munasabah untuk mencegah pelakuan sedemikian. (8) Kerajaan Persekutuan, Suruhanjaya dan pekerja serta ejen mereka tidaklah bertanggungan bagi apa-apa tindakan kerana pelanggaran kontrak atau kerana apa-apa kerugian atau kerosakan yang disebabkan oleh apa-apa pemotongan, pemberhentian, pengurangan atau penyekatan bekalan air di bawah seksyen ini. (9) Tiap-tiap pemegang lesen dan pekerja serta ejen mereka tidaklah bertanggungan bagi apa-apa tindakan kerana pelanggaran kontrak atau kerana apa-apa kerugian atau kerosakan yang disebabkan oleh apa-apa pemotongan, pemberhentian, pengurangan atau penyekatan bekalan air di bawah seksyen ini kecuali jika pemotongan, pemberhentian, pengurangan atau penyekatan bekalan air itu telah disebabkan oleh— (a) kecuaian atau perbuatan sengaja pemegang lesen, pekerja atau ejen mereka; atau (b) pelanggaran oleh pemegang lesen terhadap terma dan syarat lesennya atau peruntukan Akta ini atau perundangan subsidiarinya. (10) Seseorang yang disebut dalam perenggan (1)(c) dan (d) tidaklah bertanggungan bagi apa-apa tindakan kerana pelanggaran kontrak atau kerana apa-apa kerugian atau kerosakan yang disebabkan oleh apa-apa pemberhentian pengendalian atau pembekalan air, mengikut mana-mana yang berkenaan, di bawah seksyen ini. (11) Bagi maksud seksyen ini, suatu “kecemasan” ertinya suatu hal keadaan apabila— (a) bekalan air tidak mencukupi disebabkan oleh kemarau yang teruk atau pergolakan industri, mogok atau sekatmasuk; (b) pembekalan air atau sistem bekalan air itu membahayakan atau menimbulkan ancaman kepada keselamatan awam atau kesihatan awam; atau (c) suatu kejadian berlaku yang menimbulkan keadaan yang mendesak sehinggakan Menteri mendapati perlu untuk menjalankan kuasanya di bawah seksyen ini.
