s 13 Disqualifications applicable to office-bearers, advisers and employees of registered youth societies

(1) Subject to subsections (2) and (4), a person shall be disqualified from being, and shall not become or remain, an officebearer, adviser or employee of a registered youth society— (a) if he has been convicted of any offence against this Act; (b) if he has been convicted of any offence under any other law and sentenced to a fine of not less than five thousand ringgit or to imprisonment for a term of not less than one year or to both; (c) if there is in force against him any order of detention, restriction, supervision, restricted residence, banishment or deportation under any law relating to the security of or public order in Malaysia or any part thereof or to prevention of crime, preventive detention, restricted residence, banishment or immigration; (d) if he is an undischarged bankrupt; (e) if he is and has been found or declared to be of unsound mind; (f) if he dies; or (g) subject to section 14, if he is found to be disqualified by the Registrar from holding such office on any reasons as the Registrar may consider proper and necessary. (2) The disqualification of a person under paragraph (1)(b) shall cease at the end of the period of five years beginning with the date on which the person convicted was released from custody or the date on which the fine mentioned was imposed, as the case may be. (3) The disqualification of any person under paragraph (1)(c) shall cease as soon as such person is discharged from the relevant order. (4) The disqualification of any office-bearer due to bankruptcy shall cease when a receiving and adjudicating order has been revoked. (5) Where the Registrar, by notice under his hand notifies a youth society that any office-bearer, adviser or employee of a youth society has become disqualified under subsection (1), the youth society shall immediately give effect to such disqualification. (6) Any person who is subject to any disqualification under paragraph (1)(a), (b) or (c) may apply to the Registrar to be exempted from the application of such disqualification, and the Registrar may, if he deems it is proper to do so, grant him such exemption for such period as the Registrar may specify and subject to such limitations, restrictions, terms or conditions as he may decide to impose. (7) Any person who contravenes any provision of subsection (1), other than paragraphs (1)(e) and (f), or any limitation, restriction, term or condition imposed under subsection (6) shall be guilty of an offence and shall, on conviction, be liable to a fine not exceeding ten thousand ringgit or imprisonment for a term not exceeding three years or to both. (8) For the purposes of subsection (1), “office-bearer” includes— (a) a member of any sub-committee or other body established or formed by the governing body of a registered youth society, or by the governing body of a branch of such youth society; (b) any person who is responsible for the management of any of the affairs or the conduct of any of the activities of a registered youth society or any branch of such youth society; and (c) any person who is appointed or authorized to represent, or act on behalf of, a registered youth society or any branch of such youth society, in any matter, other than a person who, not being a member of the youth society, is engaged by the youth society to represent, or act on behalf of, the youth society or any branch of such society in his professional capacity or by contractual arrangement. (9) Any person who is, immediately before the commencement of this section, an office-bearer, advisor, or employee of a registered youth society may continue to remain as such until the expiry of the current term of his office or appointment or the termination of his contract of service, as the case may be, notwithstanding that he is disqualified under subsection (1).

Kehilangan kelayakan yang terpakai kepada pemegang jawatan, penasihat dan pekerja pertubuhan belia berdaftar

(1) Tertakluk kepada subseksyen (2) dan (4), seseorang hendaklah hilang kelayakan daripada menjadi, dan tidak boleh menjadi atau kekal, sebagai pemegang jawatan, penasihat atau pekerja sesuatu pertubuhan belia berdaftar— (a) jika dia telah disabitkan atas apa-apa kesalahan di bawah Akta ini; (b) jika dia telah disabitkan atas apa-apa kesalahan di bawah mana-mana undang-undang dan dihukum denda tidak kurang daripada lima ribu ringgit atau dipenjarakan selama tempoh tidak kurang daripada satu tahun atau kedua-duanya; (c) jika terdapat apa-apa perintah tahanan, sekatan, kawal seliaan, kediaman terhad, buang negeri atau deportasi di bawah mana-mana undang-undang yang berhubungan dengan keselamatan atau ketenteraman awam Malaysia atau mana-mana bahagiannya, atau dengan pencegahan jenayah, tahanan pencegahan, kediaman terhad, buang negeri atau imigresen yang sedang berkuat kuasa terhadapnya; (d) jika dia adalah seorang bankrap yang masih belum dilepaskan; (e) jika dia adalah dan telah didapati atau diisytiharkan sebagai tidak sempurna akal; (f) jika dia mati; atau (g) tertakluk kepada seksyen 14, jika dia didapati tidak layak memegang jawatan berkenaan oleh Pendaftar atas apaapa sebab sebagaimana yang difikirkan sesuai dan perlu oleh Pendaftar. (2) Kehilangan kelayakan seseorang di bawah perenggan 1(b) hendaklah terhenti pada akhir tempoh lima tahun bermula dari tarikh orang yang disabitkan itu dibebaskan daripada jagaan atau tarikh yang denda tersebut dikenakan, mengikut mana-mana yang berkenaan. (3) Kehilangan kelayakan mana-mana orang di bawah perenggan 1(c) hendaklah terhenti sebaik sahaja orang berkenaan dilepaskan daripada perintah yang berkaitan. (4) Kehilangan kelayakan mana-mana pemegang jawatan disebabkan oleh kebankrapan hendaklah terhenti apabila perintah penerimaan dan penghukuman telah dibatalkan. (5) Jika Pendaftar memaklumkan, melalui notis yang ditandatangani, sesuatu pertubuhan belia bahawa mana-mana pemegang jawatan, penasihat atau pekerja pertubuhan belia itu telah hilang kelayakan di bawah subseksyen (1), pertubuhan belia itu hendaklah dengan serta-merta menguatkuasakan kehilangan kelayakan itu. (6) Mana-mana orang yang kehilangan kelayakan di bawah perenggan 1(a), (b) atau (c) boleh memohon kepada Pendaftar untuk dikecualikan daripada kehilangan kelayakan tersebut, dan Pendaftar boleh, jika beliau berpendapat adalah patut berbuat demikian, memberi pengecualian kepadanya untuk tempoh sebagaimana yang ditetapkan oleh Pendaftar dan tertakluk kepada batasan, sekatan, terma atau syarat sebagaimana yang diputuskan untuk dikenakan. (7) Mana-mana orang yang melanggar mana-mana peruntukan subseksyen (1), selain perenggan (1)(e) dan (f), atau apa-apa batasan, sekatan, terma atau syarat yang dikenakan di bawah subseksyen (6) melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi sepuluh ribu ringgit atau dipenjarakan selama tempoh tidak melebihi tiga tahun atau keduaduanya. (8) Bagi maksud subseksyen (1), “pemegang jawatan” termasuklah— (a) seorang anggota mana-mana jawatankuasa kecil atau badan lain yang ditubuhkan atau dibentuk oleh badan pengelola pertubuhan belia berdaftar, atau oleh badan pengelola sesuatu cawangan pertubuhan belia itu; (b) mana-mana orang yang bertanggungjawab bagi pengurusan apa-apa hal ehwal atau penjalanan mana-mana aktiviti, sesuatu pertubuhan belia berdaftar atau mana-mana cawangan pertubuhan belia itu; dan (c) mana-mana orang yang dilantik atau diberi kuasa untuk mewakili, atau bertindak bagi pihak, pertubuhan belia berdaftar atau mana-mana cawangan pertubuhan belia itu, dalam apa-apa perkara, selain seseorang yang bukan anggota pertubuhan belia itu, diambil oleh pertubuhan belia itu untuk mewakili, atau bertindak bagi pihak, pertubuhan belia atau mana-mana cawangan pertubuhan itu dalam kapasiti profesionalnya atau melalui perkiraan kontrak. (9) Mana-mana orang yang, sebaik sebelum mula berkuat kuasanya seksyen ini, merupakan pemegang jawatan, penasihat, atau pekerja suatu pertubuhan belia berdaftar boleh, meneruskan jawatan yang berkenaan sehingga tamat tempoh semasa jawatannya atau pelantikan atau penamatan kontrak perkhidmatannya, mengikut mana-mana yang berkenaan, walaupun dia hilang kelayakan di bawah subseksyen (1).
